About this file
This is an Acquisition Alert (25-07) from February 2025 regarding Executive Order 14173 "Ending Illegal Discrimination and Restoring Merit-Based Opportunity" and its associated contractor certification requirements. The alert outlines a new certification that contractors and prospective offerors must complete to verify compliance with federal anti-discrimination laws.
The document details that EO 14173 revokes previous executive orders related to diversity, equity and inclusion (DEI), affirmative action, and equal opportunity programs, including EO 11246 on Equal Employment Opportunity. Under this new requirement, contractors must certify two key points: 1) they are in compliance with all applicable federal anti-discrimination laws, and 2) they do not operate any DEI programs that violate federal anti-discrimination laws. The certification is considered material for government payment decisions and is subject to the False Claims Act under 31 U.S.C. 3729(b)(4). The document includes a certification form for contractors to complete with fields for company name, authorized representative details, signature, and date.
