About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the supply and delivery of 9,250 men's prison grade uniforms, 750 women's prison grade uniforms, and 5,000 prison grade shoes to the Palestinian Security Forces. The total cost is $492,750. This acquisition is conducted under the authority of FAR 6.302-2, Unusual and Compelling Urgency, as the Corrections Department has an immediate need for the uniforms. The proposed contractor, Sector Security, is the sole contractor with active SAM registration and located in the West Bank, which will expedite the process compared to importing through the Government of Israel. Three local vendors were contacted, with Sector Security providing the lowest quote at $492,750. The Contracting Officer has determined the anticipated cost to the Government is fair and reasonable. The J&A will be published on SAM.gov within 30 days of contract award.

The requirement is to provide nine thousand two hundred and fifty (9250) Men’s Prison Grade Uniforms, seven hundred and fifty (750) Women’s Prison Grade Uniforms and five thousand (5000) Prison Grade Shoes to be provided to the Palestinian Security Forces. INL Jerusalem is under the DOS Office of Palestinian Affairs (OPA). INL has been tasked with supplying prison uniforms for the PA/ Corrections Division.

4. An identification of the statutory authority permitting other than full and open competition:

This acquisition is conducted under the authority 41 U.S.C. 3304(a)(2) as implemented by FAR6.3, and substantiated by the following regulatory authority:

FAR 6.302-2 Unusual and compelling urgency: An unusual and compelling urgency precludes full and open competition.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the action require use of the authority cited.

The Corrections Department has an immediate need for uniforms. The proposed contractor “Sector Security” is the sole contractor with active SAM registration and located in the West Bank. Importing through the Government of Israel (GOI) will require months of additional transit time and approvals due to the current circumstances.

Market research conducted through the internet and telephone calls. The results of the market research identified there local vendors from which bids were received as indicated under above under point bullet No.6. Sourcing outside the PA/West Bank would add additional months to the processing. Due to the conflict transit through Israeli Ports is extremely slow.

9. Any other facts supporting the use of other than full and open competition such as:

Donations of equipment for the PASF need to be approved by State of Israel Ministry of Defense (MOD). Since the vendor is located in the West Bank, MOD approval is not required.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

N/A

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
