About this file
This Addendum No. 4, issued by the Maryland Department of General Services on May 2, 2025, relates to Project No. PQ-731-240-001 for the College Park New Barrack and Garage (Barrack Q). The document provides clarifications and answers to questions regarding the solicitation, with the proposal due date set for Wednesday, May 7, 2025, by 3:00 PM Local Time. The addendum specifically addresses Minority Business Enterprise (MBE) participation requirements and procedures for the architectural and engineering services procurement.
The addendum clarifies MBE participation rules for joint ventures, explaining that a certified MBE firm can only count its own performed services towards the MBE participation goal, with a maximum of 50% of the overall MBE participation goal and 100% of any applicable subgoal. For the technical proposal, consultants must submit Form D-1A listing proposed MBE subcontractors and participation percentages, which will be reviewed during the technical evaluation process. After technical rankings, price negotiations will be conducted, during which consultants must make efforts to utilize the MBE subcontractors listed on the D1A form and strive to meet or exceed the MBE participation percentage established by the Procurement Review Group.

Proposal Due (Closing) Date and Time: Wednesday, May 7, 2025, by 3:00 PM Local Time
This Addendum includes the following:
QUESTIONS AND ANSWERS SECTION:
Question 36: My firm holds MBE certification and the firm that we may potentially pursue a Joint Venture with does not. How would that affect our status and capability to meet the MBE goals?
Answer 36: Within the joint venture, the services performed by the certified MBE firm can only be counted towards the MBE participation goal. In addition, the MBE can count towards 50% of the overall MBE participation goal and 100% of the subgoal if it applies to the project determination. Per COMAR 21.11.03.12-1 section C, regarding a Joint Venture. When a certified MBE performs as a participant in a joint venture, a procurement agency may count, subject to §D of this regulation, a portion of the total dollar value of the contract equal to the distinct, clearly defined portion of the work of the contract that the certified MBE performs with its own forces toward fulfilling the contract goal and not more than one of the contract subgoals.
Addendum No. 4 Project No. PQ-731-240-001
Question 37: For MBE Form D-1A, since a Volume II Financial Proposal is not requested to be submitted at this time, are responders to simply affirm that the minimum 25% MBE Goal is to be met on Form D-1A, or are responders to make a good faith best estimate and list the level of MBE participation that could reasonably be expected to be achieved based on the structure of their A/E Team – and in this scenario, will responders be held to achieving this good faith best estimate of the level of MBE participation as listed on the D-1A (assuming such is higher than 25%)? In either case, how does the MBE% indicated on form D-1A correlate to 6.2.6 Technical Proposal Evaluation Criteria for Minority Participation, since this percentage will not be “actual?”
Answer 37: For A&E MBE stand-alone (competitive proposal) procurements, follow the standard process used for A&E RFPs. Consultants must submit Form D1A (MBE Participation Schedule) with their technical proposals based on the scope of work. The D1A form, which lists proposed MBE subcontractors and the percentage of participation, will be reviewed as part of the technical evaluation process. After technical rankings are completed, price negotiations are conducted with the selected consultant and the Project Manager (PM). During negotiations, the consultant must make every effort to utilize the MBE subcontractors listed on the D1A form and strive to meet or exceed the MBE participation percentage established by the Procurement Review Group (PRG). Once negotiations are complete and an award is recommended, the consultant must submit Form D3 (MBE Subcontractor Participation Certification). Any changes resulting from price negotiations must not reduce MBE commitments unless justified and approved.
