About this file
This is a Justification for Other Than Full and Open Competition document supporting a sole-source award to DST innovation GmbH of Buchen, Germany.
The Department of State's Regional Procurement Support Office (Frankfurt) seeks to award a Firm-Fixed-Price contract to DST innovation GmbH on behalf of U.S. MILGP-Kenya for three complete integrated mobile biological diagnostic laboratory systems. The total estimated contract value is $2,510,640.00, inclusive of all supplies, services, shipping, and training. Each laboratory setup includes an air-transportable inflatable tent system with approximately 32 square meters of usable workspace, a mobile glovebox capable of biosafety-level-3-equivalent containment, sample collection and transportation equipment, sample preparation devices, instrumentation for PCR and ELISA analysis with light microscopy, transportable IT equipment, personal protective equipment including powered air-purifying respirators, solar-based power units with batteries, project management and pre-shipment services, international shipping and insured DDP-equivalent delivery to U.S. Embassy Nairobi, orientation courses at the contractor's German facility (up to five full working days for three designated personnel with travel included), and in-country training courses in Kenya (three-week period with at least twelve full working days of instruction covering lab orientation, setup, operation, biosafety, biosecurity, PPE use, waste management, specimen processing, diagnostics, data management, and simulation exercises). The justification cites 41 U.S. Code 1901 and FAR 12.000 as statutory authority. DST innovation GmbH is determined to be the sole source based on its unique integrated configuration combining proprietary military engineering (custom inflatable tent layouts and foldable glovebox designs meeting European DIN EN 12469 standards), proven field deployment experience from Kosovo and the West African Ebola outbreak, compatibility requirements with an existing identical deployment in Zambia to ensure standardized SOPs and shared training curricula across multiple posts, and specialized integrated training programs tailored to this specific configuration. The Contracting Officer determined pricing fair and reasonable through comparison to the prior Zambia acquisition, an independent government estimate, and market analysis of commercial laboratory equipment and training services. Three capability statements were received in response to the published Notice of Intent to Sole Source: AmeriCare LLC challenging the sole-source determination and requesting competition; Lasec International requesting a supporting complementary role without contesting the award; and Easy Biz Solutions submitted after the deadline proposing an alternative team and challenging the NAICS classification, all three of which were evaluated and rejected as not altering the Government's determination that DST innovation GmbH remains the only responsible source capable of meeting the Department's minimum needs for this integrated, interoperable capability.
