1. BASIC INFORMATION
Purpose of the Funding
The Office of Justice Programs (OJP) is committed to advancing work that furthers the U.S.
Department of Justice’s (DOJ) mission to keep our country safe and secure and uphold the rule of law and protect the rights of American citizens. OJP provides federal leadership, funding, and other critical resources to directly support law enforcement, combat violent crime, protect American children, provide services to American crime victims, and address public safety challenges, including human trafficking and the opioid crisis.
This is a notice of funding opportunity (NOFO) for the BJA FY 2026 Second Chance Act Family-Based Substance Use Disorder Treatment Program. This opportunity will provide treatment and recovery support services to parents with substance use disorders (SUD) who have minor children or are pregnant and are under correctional control in a facility or community-based setting. State, local, and tribal governments and nonprofit organizations may apply for funding to provide family-based SUD treatment programs in jail, in prison, or as part of an alternative to incarceration to reduce recidivism and improve reentry and other related outcomes for the parent and for their children. State, local, and tribal governments must apply for funding under Category 1 and nonprofit organizations and faith-based organizations must apply for funding under Category 2.
Applicants must propose to:
• Offer family-focused treatment that is clinically appropriate and includes the parent, their child, and other appropriate family members.
• Use validated tools to assess the strengths and needs of the participant and their family and use results to inform an individualized case plan.
• Offer a wide range of services based on assessed needs, including SUD treatment, as well as early child intervention services, family counseling, legal services, medical and mental health care, nursery and preschool, parenting skills, transportation, and/or vocational or GED training.
• Implement a system of incentives and sanctions based on participant progress to encourage accountability.
• Track whether each participant successfully completes the SUD treatment program.
• Conduct a process and outcome evaluation of the intervention.
Applicants proposing SUD treatment in correctional settings must also:
• Operate in an area separate from the general population of the prison.
• Provide continued care if a participant transfers to a different facility within the jurisdiction/operating area.
Applicants proposing SUD treatment in an alternative to incarceration setting must also:
• Plan to serve people charged with a nonviolent drug offense (drug or drug-related crimes that do not include an element of physical force against person or property, their child, and other appropriate family members).
U.S. Department of Justice | Office of Justice Programs | Bureau of Justice Assistance | 4
• Ensure all treatment providers are approved by the state or tribe and are licensed, if necessary, to provide medical and other health services.
• Coordinate with the Single State Authority for Substance Abuse in the applicable state.
• Provide treatment in a residential setting (this does not include hospital or intensive outpatient settings).
• Ensure that those who do not successfully complete the program serve an appropriate sentence of imprisonment for their original offense.
Examples of allowable uses of funds include:
• Hiring personnel.
• Paying for mental health, substance use, and/or overdose prevention medication.
• Contracting to support service delivery (e.g., case management, peer support, or clinically-appropriate treatment) and/or training and evaluation services.
See the Eligible Applicants section for eligibility details.
The Second Chance Act of 2007 and the First Step Act of 2018 authorize federal grants to facilitate reentry services and programs for people leaving incarceration. In FY26, BJA is releasing six NOFOs to support adults reentering the community and enhance public safety in different ways. Applicants are welcome to seek funding through more than one NOFO.

(a) Directly supporting law enforcement operations (including immigration law enforcement operations);
(b) Combatting violent crime;

In addition to the agency priorities listed above, priority consideration will also be given under this NOFO to applicants in states and units of local government that actively meet the criteria below, to the maximum extent permitted by law:
(i) enforce prohibitions on open illicit drug use;
(ii) enforce prohibitions on urban camping and loitering;

Applicants seeking this additional priority consideration, should complete the Agency
Funding Priorities Inventory—Ending Crime and Disorder (Funding Priority Inventory 3) in JustGrants to indicate which criteria they are actively meeting.
Note: Addressing these priorities is one of many factors that OJP considers in making funding decisions. Receiving priority consideration does not guarantee funding.
Unallowable Activities: The following are certain unallowable costs and certain activities that are out of the program scope and will not be funded.
1. Out of program scope is any program or activity, at any tier that, directly or indirectly, violates (or promotes or facilitates the violation of) federal immigration law (including 8 U.S.C. § 1373) or impedes or hinders the
U.S. Department of Justice | Office of Justice Programs | Bureau of Justice Assistance | 8 enforcement of federal immigration law—including by failing to comply with 8 U.S.C. § 1373, give access to DHS agents, or honor DHS requests and provide requested notice to DHS agents.
2. Out of program scope is any program or activity, at any tier that violates any applicable Federal civil rights or nondiscrimination law. This includes violations that (1) indirectly violate the law, including by promoting or facilitating violations; or (2) unlawfully favor individuals in any race or protected group, including on a majority or minority, or privileged or unprivileged, basis, within a given area, population, or sector.
3. As specified in the DOJ Grants Financial Guide, in Chapter 3.13 “Unallowable Costs” (“Legal Services for Aliens”), any obligations of funds, at any tier, under this award to provide (or to support the provision of) legal services to any removable alien or any alien otherwise unlawfully present in the United States shall be unallowable costs for purposes any award made under this notice, but the foregoing shall not be understood to apply— (1) to legal services to obtain protection orders for victims of crime; or (2) to immigration-related legal services that may be expressly authorized or required by any law, or any judicial ruling, governing or applicable to the award.
Goals and Objectives of This Funding Opportunity
Goal: Address underlying SUDs to reduce crime and recidivism by parents of minor children.
• Objective 1: Implement or enhance corrections-based SUD treatment and recovery support services to parents and their minor children and families.

APPENDIX B: MANDATORY TREATMENT SERVICE
PROVIDER CERTIFICATION, PROVIDER
LICENSING/ACCREDITATION/CERTIFICATION
DOCUMENTATION REQUIREMENT
As the authorized representative of [insert name of applicant organization], I assure the Bureau of Justice Assistance the following:
All collaborating service provider organizations listed in this application meet applicable licensing, accreditation, and certification requirements.
As the authorized representative, I also understand that the following information is required to receive funding, and these materials have been included with the application materials:
• Letter of commitment that specifies the nature of the participation and what service(s) will be provided from every service provider organization listed in the application that has agreed to participate in the project.
• Documentation that all service provider organizations collaborating on the project have been providing relevant services for a minimum of 2 years prior to the date of the application in the area(s) in which services are to be provided.
Official documents definitively establish that the organization has provided relevant services for the last 2 years.
• Documentation that all collaborating service provider organizations are in compliance with all local (city, county), state, and tribal requirements for licensing, accreditation, and certification or official documentation from the appropriate agency of the applicable state, tribal, county, or other governmental unit that licensing, accreditation, and certification requirements do not exist.
Note: Official documentation is a copy of each service provider organization’s license, accreditation, and certification. Documentation of accreditation will not be accepted in lieu of an organization’s license.
A statement by, or letter from, the applicant organization or from a provider organization attesting to compliance with licensing, accreditation, and certification, or that no licensing, accreditation, or certification requirements exist, does not constitute adequate documentation.
