About this file

This Phase I Environmental Site Assessment document, prepared by the City of Salem Environmental Services for the City of Salem Engineering Division, evaluates the Batzer Property located northwest of the intersection of Silverton Road NE and Beach Avenue NE in Salem, Oregon. The 337-square-foot landscaped commercial property comprises the southeast portion of Tax Lot 4701 in Marion County. The assessment was conducted in conformance with Title 40 CFR Part 312 and ASTM E1527-21 standards. The report is valid through September 7, 2025, based on the initial data collection date of March 11, 2025. A site reconnaissance was conducted on March 26, 2025, and interviews were completed with the current property owner (John Batzer), current occupant (Qing Qing Yu of Holland's Bar & Grill), and local government officials including representatives from City of Salem Environmental Services and the Fire Department. Historical review of sources from 1915 through present indicates the property was used for agricultural and rural residential purposes through the 1930s, then developed as landscaping associated with residential use through 1975 and commercial use from 1979 to present.

The environmental records review identified 116 surrounding sites listed on regulatory databases within ASTM search distances; however, based on topography, groundwater flow direction, and regulatory status, the assessment concludes none of these sites constitute a Recognized Environmental Condition (REC) affecting the subject property. A previous Level I ESA conducted by Abiqua Engineering in 1993 found no evidence of RECs. No findings indicative of RECs, Historical RECs, Controlled RECs, or de minimis conditions were identified during the current assessment, nor were any data gaps found. The assessment concludes that no further environmental inquiries regarding the subject property are warranted at this time, and the property poses no evidence of contamination that would warrant Phase II investigation or impose environmental liability.

PREVIOUS REPORTS

Abiqua Engineering performed a Level I ESA in 1993 that included the subject property and adjoining sites to the west. The assessment indicated no evidence of a REC within the assessed area.

ENVIRONMENTAL RECORDS REVIEW

Federal, tribal, state, and local environmental records and databases were compiled for the subject property and facilities that currently or previously have occupied properties within the specified search distance from the subject property. Information contained in the records and databases was reviewed by City of Salem to evaluate the potential for environmental impacts to the subject property.

Subject Property The subject property was not identified on the environmental records and databases reviewed.

Surrounding Sites The EDR Radius Map Report identified 116 surrounding sites listed on one or more regulatory databases within the ASTM search distances. Based on the local topography, inferred direction of shallow groundwater flow, regulatory status of the ii Batzer Property | PN 722526 listed sites, media impacted at the listed sites, and information contained in the regulatory databases, it is our professional opinion that none of the 116 surrounding sites constitute a REC at the subject property.

HISTORICAL USES – SUBJECT PROPERTY AND ADJOINING PROPERTIES

Our review of historical sources from 1915 through the present indicates that the subject property was likely used for agricultural and/or rural residential purposes prior to the 1930s, and by 1936 was developed as landscaping that was associated with residential use through 1975, and commercial use from 1979 through present.

Our review of historical sources from 1915 through the present indicates the adjoining properties were likely used for agricultural and/or rural residential purposes through 1917. Sites to the north and east were developed for residential use in the 1920s, and sites to the west were developed for residential and commercial use in the 1930s. By 1948, the site to the southeast was occupied by the Oregon State Fairgrounds. The residence immediately to the west was repurposed for commercial use by 1979, and the structure was removed by 2000.

SITE RECONNAISSANCE

Based on the site reconnaissance, RECs were not identified in conjunction with the current use of the subject property.

FINDINGS AND OPINIONS

During the course of this assessment, no findings indicative of RECs, HRECs, CRECs, or de minimis conditions were identified, nor were any data gaps identified.

CONCLUSIONS AND RECOMMENDATIONS

City of Salem performed a Phase I ESA in conformance with the scope and limitations of ASTM E1527-21 and all appropriate inquiries specified in 40 CFR Part 312 for the subject property located northwest of the intersection of Silverton Road NE and Beach Avenue NE in Salem, Oregon. Any exceptions to or deletions from this practice are described in Sections 3.0 and 12.0. In our opinion, this assessment has revealed no evidence of RECs, HRECs, or CRECs in connection with the subject property. It is our professional opinion that no further environmental inquiries regarding the subject property are warranted at this time.

1.0 INTRODUCTION

This report summarizes the results of a Phase I ESA of the Batzer Property located northwest of the intersection of Silverton Road NE and Beach Avenue NE in Salem, Oregon (subject property). The subject property includes the southeast portion of Tax Lot 4701 of Marion County Tax Map 07 3W 13BC and consists of 337 square feet of landscaped commercial property. The subject property layout and surrounding properties are shown on Figure 1. Acronyms and abbreviations used herein are defined above, immediately following the Table of Contents.

Phase I ESAs have a limited viability as specified in Section 4.6 “Continued Viability of the Site Assessment” of ASTM E1527-21. According to ASTM E1527-21, a

Phase I ESA is valid for a period of 180 days from the date of the first data collected for the assessment. On the basis of the first data collected (March 11, 2025), this Phase I ESA report is considered valid through September 7, 2025.

2.0 PURPOSE

2.1 PROTECTION FROM CERCLA LIABILITY

One purpose for conducting a Phase I ESA is to undertake all appropriate inquiries into prior ownership and uses of a property so that a prospective purchaser may potentially claim protection from CERCLA and/or state liability as an innocent landowner, a bona fide prospective purchaser, or a contiguous property owner. The standards and practices for all appropriate inquiries are specified in Title 40, Chapter I of CFR Part 312. The inquiry must be conducted by an environmental professional to identify conditions indicative of releases and threatened releases of hazardous substances as defined in CERCLA Section 101(22). If the prospective purchaser is the recipient of an EPA Brownfields grant, the inquiry must also identify conditions indicative of releases and threatened releases of petroleum and petroleum products and controlled substances as defined in 21 U.S. Code 802.

These standards and practices do not require the identification of quantities of hazardous substances, petroleum and petroleum products, and controlled substances that, because of said quantity, generally would not pose a threat to human health or the environment.

2.2 IDENTIFICATION OF RECOGNIZED ENVIRONMENTAL CONDITIONS

Another purpose for conducting a Phase I ESA is to identify RECs in connection with a property as they pertain to ASTM E1527-21. This practice is intended for use by parties who wish to assess the environmental condition of a property by taking into account commonly known and reasonably ascertainable information. Although conformance with ASTM E1527-21 constitutes all appropriate inquiries as described in Section 2.1,the standard is intended primarily as an approach to identify RECs in connection with a property. A REC is defined in ASTM E1527-21 by (1) the presence of hazardous substances or petroleum products in, on, or at the subject property due to a release to the environment; (2) the likely presence of hazardous substances or petroleum products in, on, or at the subject property due to a release or likely

2 Batzer Property | PN 722526 release to the environment; or (3) the presence of hazardous substances or petroleum products in, on, or at the subject property under conditions that pose a material threat of a future release to the environment. RECs do not include de minimis conditions that do not generally present a risk to public health or the environment and would not be the subject of legal enforcement if brought to the attention of appropriate governmental agencies.

A CREC is defined by ASTM E1527-21 as a REC affecting the subject property that has been addressed to the satisfaction of the regulatory authority or authorities, with hazardous substances or petroleum products allowed to remain in place subject to the implementation of required controls. Examples of required controls include property use restrictions, AULs, institutional controls, and engineering controls. A condition considered by the environmental professional to be a CREC is considered a REC.

An HREC is defined by ASTM E1527-21 as a previous release of hazardous substances or petroleum products affecting the subject property that has been addressed to the satisfaction of the applicable regulatory authority or authorities and meeting unrestricted use criteria established by the applicable regulatory authorities without subjecting the property to any required controls such as property use restrictions, AULs, institutional controls, and engineering controls. An HREC is not considered a REC. Before calling the past release an HREC, the environmental professional must determine whether the past release is a REC at the time the Phase I ESA is conducted (for example, if there has been a change in regulatory criteria). If the environmental professional considers the past release to be a REC, such as not meeting regulatory standards for unrestricted use in place at the time the Phase I ESA is conducted, the condition shall be considered a REC.

3.0 SCOPE OF SERVICES

The scope of services for this project was performed in conformance with the standards and practices for all appropriate inquiries specified in 40 CFR Part 312 and the scope and limitations of ASTM E1527-21. The specific scope of services performed included the following:

• Reviewed a current USGS topographic map to identify the physical setting of the subject property.

• Reviewed federal, tribal, state, and local environmental records for listings of known or suspected environmental conditions at the subject property or nearby properties as specified in 40 CFR Part 312 and ASTM E1527-21.

• Reviewed reasonably ascertainable standard historical sources, including aerial photographs, USGS topographic maps, reverse city directories, fire insurance maps, online property information (including available building department records, property tax information, and zoning/land use records), and other historical sources, as appropriate, to identify development history on and adjoining the subject property relative to the possible use, generation, storage, 3 Batzer Property | PN 722526 release, or disposal of hazardous substances.

• Interviewed the current owner of the subject property, an occupant of the subject property, and local government officials regarding their knowledge of the subject property.

• Conducted a visual reconnaissance of the subject property and adjoining properties to obtain information indicating the likelihood of identifying RECs concerning the subject property.

• Prepared this report that presents our findings and provides conclusions and recommendations.

The scope of services was limited to only the items listed above. This project did not include completion of an environmental compliance audit; an evaluation for the presence of PCBs in light ballasts; a survey for asbestos, lead-based paint, radon gas, toxic mold, biological pollutants, or urea-formaldehyde insulation; or a wetlands determination or delineation.

4.0 SUBJECT PROPERTY AND VICINITY DESCRIPTION

Information concerning the physical setting of the subject property and vicinity is based on a review of the USGS 7.5-minute Salem West, Oregon, topographic quadrangle map; information provided by EDR of Shelton, Connecticut; and observations made during a site reconnaissance conducted on March 26, 2025.

The subject property encompasses approximately 337 square feet located northwest of the intersection of Silverton Road NE and Beach Avenue NE in Salem, Oregon.

The subject property is currently owned by Royal Trust/Batzer, John E/Batzer, R Russell is landscaped commercial property. The subject property includes the southeast portion of Tax Lot 4701 in the southwest quarter of the northwest quarter of Section 13, Township 7 South, Range 3 West of the Willamette Meridian.

The subject property is situated at an elevation of approximately 170 feet above MSL. The topography of the subject property is generally level. Based on a review of a Level I ESA conducted at the subject property (described in Section 6.0), topographic maps for the area, and reports for nearby sites identified by the environmental records review, shallow groundwater beneath the subject property is expected to be present at a depth of approximately 25 feet BGS and is anticipated to flow west-northwest toward the Willamette River.

Land use in the vicinity of the subject property is primarily commercial, residential, and institutional. According to the City of Salem Planning Department, the subject property is zoned “Retail Commercial (CR)”. Properties surrounding the subject property are zoned “Retail Commercial (CR)” and “Public Amusement (PA)”.

6.0 PREVIOUS REPORTS

City of Salem reviewed a previous environmental report regarding the subject property and adjoining properties. The findings and conclusions of the following report are summarized below:

• Level I Environmental Site Assessment; 2155 Silverton Road; Salem, Oregon, prepared by Abiqua Engineering, Inc., dated November 1993

Abiqua Engineering Inc. (Abiqua) performed a Level I Environmental Site Assessment of the subject property, and adjoining sites to the west, including 2155 and 2195 Silverton Road NE and 1940 Beach Avenue NE. The assessment indicated no evidence of a REC at the subject property or the adjoining sites to the west. Interviews conducted during the assessment indicated that a furniture refinishing shop occupied a commercial structure on the adjoining site to the west for a six-month period sometime between 1991 and 1993. No evidence of a release of hazardous materials associated with the furniture shop was observed during the assessment.

7.0 ENVIRONMENTAL RECORDS REVIEW

Federal, tribal, state, and local environmental records and databases were compiled according to 40 CFR Part 312 and ASTM E1527-21 for the subject property and those facilities that currently or previously have occupied properties within the specified search distance from the subject property. Information contained in the records and databases was reviewed by City of Salem to evaluate the potential for environmental impacts to the subject property. The EDR Radius Map Report is presented in Appendix B.

7.1 SUBJECT PROPERTY

The subject property was not listed on any of the government records or databases searched by EDR.

7.2 SURROUNDING SITES

The EDR Radius Map Report identified 116 surrounding sites listed on one or more regulatory databases within the ASTM search distances. Based on changes in ownership, address, multiple regulatory listings, and multiple regulatory actions, two or more of the surrounding site listings may actually represent only one physical location. Therefore, the number of surrounding sites is likely less than reported by EDR. Based on the local topography, inferred direction of shallow groundwater flow, regulatory status of the listed sites, media impacted at the listed sites, and information contained in the regulatory databases, it is our professional opinion that none of the 116 sites represent a REC at the subject property. However, due to their close proximity to the subject property, two of the listed sites are discussed in the following sections.

6 Batzer Property | PN 722526

7.2.1 Larry’s Texaco Gas Station

The Larry’s Texaco Gas Station (Texaco) site is located at 2090 Silverton Rd NE.

While the EDR report indicates the Texaco site is located approximately 260 feet southwest of the subject property, historical Sanborn maps indicate the Silverton Road address numbering has changed since the Texaco site was listed in 1961.

The Texaco site was likely located greater than 1000 feet the southwest, which is downgradient in the inferred groundwater flow direction. The Texaco site was listed on the EDR Historical Auto database. Based on historical information, the distance from the Texaco site to the subject property, and its location downgradient in the inferred direction of groundwater flow, it is our professional opinion the Texaco site does not represent a REC at the subject property.

7.2.2 Lana Avenue Service Station Gas

The Lana Avenue Service Station Gas site (Lana Gas Station) is located at 2005 Lana Avenue NE, approximately 600 feet northeast of the subject property and up gradient of the subject property in the inferred groundwater flow direction. The Lana Gas Station site was listed on the EDR Historical Auto database. According to the database, a fuel service station operated at the Lana Gas Station site from at least 1951 through 1976. No releases have been reported at the Lana Gas Station site.

Based on the relatively brief use of the Lana Gas Station site as a gas service station and the distance from the Lana Gas Station site to the subject property, it is our professional opinion that the Lana Gas Station site does not represent a REC at the subject property.

7.3 ORPHAN SITES

Due to poor or inadequate address information, EDR was unable to successfully map one facility identified on several environmental databases. However, enough information was available to ascertain the general location of this orphan facility relative to the subject property and, in some cases, the status of the investigations concerning this orphan site. Based on the location of the orphan site, regulatory status of the listed site, and information contained in the regulatory databases, it is our professional opinion that this orphan site does not represent a REC at the subject property.

8.0 SUBJECT PROPERTY HISTORY AND BACKGROUND

Reasonably ascertainable information concerning the history and background of the subject property begins in 1915 and includes aerial photographs, USGS topographic maps, reverse city directories, Sanborn fire insurance maps, online property information (including available property tax information, and zoning/land use records), and personal knowledge of individuals familiar with the subject property.

7 Batzer Property | PN 722526

Historical aerial photographs of the subject property were obtained from EDR and reviewed by City of Salem. The scale of the photographs reviewed allowed for the interpretation of general site development/configuration but did not allow for the identification of specific subject property features. Aerial photographs were reviewed for the following years: 1936, 1948, 1954, 1963, 1967, 1970, 1975, 1980, 1982, 1994, 2000, 2006, 2009, 2012, 2016, and 2020. The historical aerial photographs are presented in Appendix C.

Historical topographic maps of the subject property were obtained from EDR and reviewed by City of Salem. Topographic maps were reviewed for the following years:

1915, 1917, 1925, 1939, 1940/1941, 1957, 1969, 1975, 1986, 2001, 2014, 2017, and 2020. The topographic maps for the years 1925 and 1975 do not encompass the subject property or adjoining properties. The historical topographic maps are presented in Appendix C.

Reverse city directories for the subject property and adjoining properties were obtained from EDR and reviewed by City of Salem. Please note that in some locations, particularly in urban areas, addresses for a particular property may change over time. Based on a review of Sanborn fire insurance maps and historical property information, the following addresses historically correspond to the subject property: 3095 Silverton Road (1950), 2195 Silverton Road NE (1978 – present).

The city directories were reviewed (if available) at approximately five-year intervals for the years spanning 1924 through 2020. The EDR City Directory Report is presented in Appendix C.

Sanborn fire insurance maps for the subject property were obtained from EDR and reviewed by City of Salem. Sanborn fire insurance maps were reviewed for the following years: 1926, 1950, and 1978. The Sanborn fire insurance map for the year 1926 does not encompass the subject property or adjoining properties. The Sanborn fire insurance maps are presented in Appendix C.

Online property information for the subject property and select adjoining properties was reviewed by City of Salem. The online property information is presented in Appendix D.

12.0 LIMITATIONS

This Phase I ESA has been prepared for use by the City of Salem Engineering Division. City of Salem makes no warranties or guarantees regarding the accuracy or completeness of information provided or compiled by others. The information presented in this report is based on the above-described research and a single recent site visit. Information provided by others was relied on in our description of historical conditions and review of regulatory databases and files. The available data do not provide definitive information with regard to all past uses, operations, or incidents at the subject property or adjoining properties. Performance of this practice is intended to reduce, but not eliminate, uncertainty regarding the potential for RECs in connection with a property. There is always a potential that areas with contamination that were not identified during this assessment exist at the subject property or in the study areas. Further evaluation of such potential would require additional research, subsurface exploration, sampling, and/or testing.

Some substances may be present in the subject property vicinity in quantities or under conditions that may have led or may lead to contamination of the subject property but are not included in current local, state, or federal regulatory definitions of hazardous substances or do not otherwise present current potential liability.

This report is not intended for use by others, and the information contained herein is not applicable to other sites. Reliance on this report by other parties is strictly at the risk of those parties.

Within the limitations of scope, schedule, and budget, our services have been executed in accordance with the generally accepted environmental science practices for Phase I ESAs in this area at the time this report was prepared. No warranty or other conditions, express or implied, should be understood.
