Summary of Performance Bond Document

This is a Faithful Performance Bond document prepared for the County of Orange, California. The bond serves as a contractual guarantee requiring the selected contractor to fulfill all obligations under the awarded boat equipment contract. The bond establishes a joint and several liability between the contractor (Principal) and an authorized California surety company, binding both parties to the County for the penal sum to be determined based on the contract price. The bond obligates the contractor to comply with all covenants, conditions, and agreements specified in the underlying contract, maintain performance standards, and indemnify and defend the County against any breaches or failures to perform. The surety waives notice of any contract modifications, time extensions, or specification changes and remains fully liable regardless of such alterations. The document requires notarization of the surety representative's signature and must be approved by both the County's Risk Management office and County Counsel before execution.

The performance bond amount equals the estimated contract value for the boat equipment procurement, which includes two Ilmor 6.2L GDI marine engines and two Veratron VMH 70 glass cockpit displays. Contractor execution of the bond must comply with California Corporations Code section 313, requiring either dual signatures from specified corporate officers or a single officer signature accompanied by written authorization documentation such as a corporate resolution. The County may recover all reasonable costs, expenses, and attorney fees incurred in enforcing the bond obligation, which shall be taxable as costs and included in any judgment rendered against the contractor or surety. Submission of this executed bond is mandatory prior to contract award, and the bond must remain in effect throughout the contract term to ensure faithful performance of all deliverables and service obligations.
