About this file

This is a Faithful Performance Bond document required by the County of Orange, California for a contract involving the purchase and delivery of a 28' Brunswick 280 Justice Patrol Boat. The bond secures the contractor's obligation to perform all work and fulfill all covenants, conditions, and agreements specified in the underlying contract. The bond requires the principal contractor and a surety company authorized to conduct business in California to be jointly and severally liable to the County in a penal sum equal to or exceeding the contract price. The contractor must deliver the patrol vessel within 365 days of contract execution to the Sheriff-Coroner Department Harbor Patrol Administration in Corona del Mar during regular business hours (8:00 AM to 4:00 PM PST, Monday through Friday). Electronic bids must be submitted through the County's online procurement portal by March 12, 2026 at 4:00 PM PST, with questions due by February 25, 2026 at 4:00 PM. The contract will be awarded to the lowest responsive, responsible bidder on a firm fixed-price basis with a one-year initial term and no automatic renewal.

The performance bond must include the surety company's typed or stamped name and notarized signature with an attached certificate of notarization. The bond agreement specifies that changes, extensions, alterations, or additions to contract terms, work specifications, or conditions do not affect the surety's obligations, and the surety waives notice of any such modifications. The County must approve the surety and bond limits, and the Office of the County Counsel must approve the bond as to form. Additionally, the contractor must provide a Labor and Material Payment Bond with a penal sum equal to or exceeding the contract price. Qualified bidders must demonstrate a minimum of five years in business, maintain a brick-and-mortar location, carry $1,000,000 general liability insurance and $1,000,000 auto liability with the County named as additional insured, and meet all federal, state, and local permit requirements. A five percent preference deduction applies to certified Orange County Local Small Business (OCLSB) or Disabled Veteran Business Enterprise (DVBE) bidders for evaluation purposes, with a maximum allowable preference of $100,000. Payment will be made in arrears within 30 days of invoice receipt and acceptance of goods.
