About this file

This is a Performance Bond template issued by the County of Orange, California, for use in securing faithful performance of county contracts. The bond document establishes the legal framework requiring contractors to furnish a bond guaranteeing complete performance of contracted work in accordance with all terms, conditions, agreements, and specifications. The bond obligates both the principal (contractor) and surety (bonding company) jointly and severally to the County in a penal sum to be determined based on the contract value. The document requires execution by authorized corporate signatories following California Corporations Code Section 313 requirements, with the surety representative's signature notarized and a certificate of notarization attached. The bond becomes null and void upon satisfactory completion of all contract obligations; otherwise, it remains in full force. The County retains the right to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation, which shall be taxed as costs in any judgment rendered.

The surety waives notice of any changes, extensions of time, alterations, or additions to contract terms, work specifications, or scope modifications. Approval authority rests with both the County's CEO/Risk Management office and the Office of the County Counsel. The bond template applies to the Fresh Produce supply contract (IFB #060-2995502-MB2) for the Sheriff-Coroner Department, which requires delivery of produce to four county penal institutions at least twice weekly with pricing firm for the initial contract year and no price increases permitted. The initial contract term runs two calendar years effective May 6, 2026, with two optional one-year renewal periods available by mutual written agreement. Bids are due electronically by March 12, 2026, at 4:00 p.m. through the County's eProcurement Portal, with the contract awarded to the lowest responsive, responsible bidder. Performance and Labor and Material Payment Bonds are mandatory requirements, with bond penal sums calculated based on estimated contract value.
