About this file
This is a Performance Bond form for the County of Orange, California, used to secure the faithful performance of contracts awarded by the County. The bond serves as a financial guarantee that the contractor will complete all work in accordance with the contract terms, conditions, and specifications. The form requires the contractor (Principal) and a surety company authorized to conduct business in California to be jointly and severally liable to the County in a penal sum to be determined based on the contract value. The bond must be executed with proper notarization of the surety representative's signature, and the surety company name must be typed or stamped above the signature line. The document becomes void upon successful completion of all contract obligations; otherwise, it remains in full force. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms, work specifications, or performance requirements.
The bond premium is calculated at a specified rate per thousand dollars of the contract price, though the exact premium amount and rate are left blank for completion on individual bonds. The County reserves the right to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation, which are to be taxed as costs and included in any judgment rendered against the Principal or Surety. Contractor signature authority is governed by California Corporations Code Section 313, requiring either two authorized corporate officers (such as CEO/President and Secretary/CFO) or a single officer with written evidence of delegated authority. County approval of the surety and bond limits is required, along with approval as to form by the Office of the County Counsel.
