About this file

This is a Faithful Performance Bond template issued by the County of Orange, California, for use by contractors awarded County contracts. The bond serves as a guarantee of faithful performance by the principal contractor and requires a surety company authorized to conduct business in California. The bond is conditioned upon the contractor's complete performance of all contract obligations, covenants, conditions, and agreements as specified in the underlying contract documents, with the penal sum amount to be determined based on the contract price. The surety waives notice of any contract changes, extensions of time, alterations, or additions to the contract terms, specifications, or work scope. The bond must be executed with the surety representative's signature notarized and a notarization certificate attached. Corporate signatories must comply with California Corporations Code Section 313, requiring either two authorized officers to sign (chairman, president, vice president, secretary, assistant secretary, chief financial officer, or assistant treasurer) or one officer with written evidence of authority to bind the corporation. The bond document must be approved as to form by the County's Office of the County Counsel and as to surety and limits by the County's CEO or Risk Management office.

For the related procurement (IFB #012-3043003-LS) for park furniture and receptacles, all awarded contractors are required to furnish both a Faithful Performance Bond and a Labor and Material Payment Bond with penal sums based on the final contract price. The bond premium costs will be negotiated between the contractor and the surety company and are the responsibility of the contractor to obtain and fund. Bidders must submit electronic bids by April 21, 2026, at 2:00 p.m., with questions due by April 14, 2026, at 2:00 p.m. Within seven days of award notification, the successful bidder must provide the executed Faithful Performance Bond along with proof of insurance, W-9 forms, and California registration documentation. The contract will be awarded to the lowest responsive, responsible bidder, with bid prices remaining firm for the entire contract term and valid for 365 days following the solicitation closing date.
