About this file
This is a Performance Bond template document issued by the County of Orange, California, for use in roadway banner services contracts awarded through competitive bidding. The bond requires contractors to provide faithful performance guarantees for work performed under County contracts, with the surety company jointly and severally liable to the County for the penal sum specified in the contract agreement. The bond must be executed with notarized signatures from both the contractor and the surety representative, with the surety company name typed or stamped on the document. The bond remains in effect for any alterations, extensions, or additions to the underlying contract terms, and the surety waives notice of such changes. Approval authority rests with the County's CEO/Risk Management division and the Office of the County Counsel. Corporate signatories must comply with California Corporations Code section 313 requirements, which mandate either dual signatures from specified officer positions or single-signature authorization supported by corporate resolution documentation.
The performance bond secures the contractor's obligation to complete all work in accordance with contract specifications, timelines, and conditions, with the County entitled to recover all costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation. The bond premium is calculated at a specified rate per thousand dollars of contract value, and any judgment rendered against the contractor and surety includes these enforcement costs as taxable expenses. The surety's obligation extends to indemnifying, defending, and holding harmless the County and its officers and agents as stipulated in the underlying contract. All bond documents become property of the County subject to California Public Records Act disclosure requirements.
