About this file

This is a Faithful Performance Bond form issued by the County of Orange, California, required as a contractual security instrument for vendors entering into agreements with the County. The bond serves as a guarantee that the contractor will faithfully perform all obligations outlined in the underlying contract, with the penal sum amount to be determined based on the contract value. The surety company executing the bond assumes joint and several liability with the contractor to ensure compliance with all covenants, conditions, and agreements specified in the contract, including adherence to all alterations, specifications, and performance timelines as originally stipulated.

The performance bond requires execution by authorized corporate officers and the surety's representative, with notarization of the surety's signature and attachment of the notarization certificate. The County of Orange Office of the County Counsel must approve the bond as to form, while the CEO/Risk Management division must approve the surety and limits. The bond obligates the surety to indemnify, defend, and hold harmless the County, its officers, and agents, with the surety waiving notice of any changes, extensions, or alterations to the underlying contract terms. The bond premium amount and rate per thousand dollars of the contract price are to be inserted by the surety, and any enforcement costs, reasonable expenses, and fees incurred by the County in pursuing the bond obligation are to be taxed as costs and included in any resulting judgment.
