About this file

This is a Performance Bond document for the County of Orange, California, required as part of a fresh produce supply contract (IFB #060-2995502-MB2) with the Sheriff-Coroner Department. The bond serves as a faithful performance guarantee, binding the contractor and surety jointly and severally to the County for the successful completion of contract obligations. The bond must include a notarized signature from the surety's representative, with the surety company name typed or stamped above the signature line. The penal sum amount is to be determined based on the estimated contract value, and the bond remains in effect for the duration of the contract term, which runs for two calendar years beginning May 6, 2026, with options for two additional one-year renewals by mutual written agreement. The document requires approval from both the County's CEO/Risk Management and the Office of the County Counsel before execution.

The Performance Bond obligates the contractor to indemnify, defend, and hold harmless the County, its officers, and agents in accordance with the underlying contract terms and specifications. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms or work specifications, and agrees that such modifications do not affect its obligations under the bond. The bond must comply with California Corporations Code section 313, requiring either two authorized corporate signatories or one officer with written evidence of binding authority. The County reserves the right to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered. No specific bond premium rate or penal sum is stated in the template; these figures will be completed based on the final contract value once awarded to the lowest responsive, responsible bidder.
