About this file

This is a Faithful Performance Bond template issued by the County of Orange, California, for use in conjunction with competitive contracts. The bond serves as a guarantee that the principal contractor will faithfully perform all obligations, covenants, conditions, and agreements specified in the underlying contract. The document is designed to be completed for the FLIR K65 Thermal Imaging Cameras procurement solicitation issued by the County of Orange Sheriff-Coroner department. The bond requires completion of blank fields including the contract date, contractor name and address, surety company name and address, bond number, premium amount, and penal sum amount. The bond obligates both the principal and surety jointly and severally to the County for faithful performance and requires that the surety indemnify and defend the County against any breach of contract obligations.

The performance bond must include a notarized signature from the surety representative with an attached certificate of notarization, and the surety company name must be typed or stamped above the signature line. The penal sum typically represents a percentage of the total contract price, calculated at a specified rate per thousand dollars of contract value. The bond includes a waiver clause preventing the surety from claiming that contract changes, time extensions, alterations, or specification modifications affect its obligations. County approval of both the surety and bond limits must be obtained through the CEO/Risk Management office, and the County Counsel's office must approve the form. For corporate signatories, California Corporations Code Section 313 requirements mandate either dual signatures from specified officers or a single officer signature accompanied by written evidence of authority, such as a corporate resolution.
