About this file

This is a Faithful Performance Bond document required by the County of Orange, California for contractors engaged in service delivery. The bond serves as a financial guarantee that the Principal (Contractor) will faithfully perform all obligations, covenants, conditions, and agreements specified in the underlying contract for a Digital Fire Extinguisher Training System. The bond is executed jointly and severally by the Principal and the Surety (bonding company), binding both parties to indemnify and defend the County and its officers and agents. The document requires notarization of the Surety representative's signature and typed or stamped identification of the Surety company name above the signature line.

The penal sum amount of the bond and premium rate are to be specified at the time of contract execution and are calculated as a percentage of the total contract price. The Surety waives notice of any changes, extensions, alterations, or additions to the contract terms, work specifications, or performance schedule, maintaining full obligation regardless of such modifications. The bond remains in effect for the entire duration of contract performance and includes provisions for recovery of the County's costs, expenses, and reasonable attorney fees incurred in enforcing the bond obligation, which are taxable as costs and includable in any judgment. Corporate signatories must comply with California Corporations Code section 313, requiring either two authorized officers or one officer with documented authority to execute the bond on behalf of the contractor.
