About this file
This is a Faithful Performance Bond template document issued by the County of Orange, California, for use in securing contract performance obligations. The bond serves as a guarantee that contractors will faithfully perform all terms, conditions, and covenants specified in their respective contracts with the County. The template allows for the insertion of specific bond details including the bond number, premium charged at a stated rate per thousand dollars of contract price, contractor name and address, surety company name and address, and the penal sum amount. The bond requires joint and several liability between the principal contractor and the surety, binding them to indemnify and defend the County and its officers and agents against non-performance or breach of contract obligations.
The bond document requires execution by authorized corporate officers in compliance with California Corporations Code Section 313, with signatures from either two specified officers or one officer with written evidence of authority to bind the corporation. The surety representative's signature must be notarized with the certificate of notarization attached to the document. The surety waives notice of any changes, extensions, alterations, or additions to contract terms and agrees that such modifications will not affect its obligations under the bond. The bond includes provisions for the County to recover all reasonable costs, expenses, and fees incurred in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered against the principal or surety.
