About this file

This is a Performance Bond template document for the County of Orange, California, used to secure contractor performance on county contracts. The bond serves as a faithful performance guarantee requiring the contractor and surety to be jointly and severally liable for the completion of contract work in accordance with all terms, conditions, and specifications. The bond amount, premium rate, contract date, contractor information, and surety company details are to be completed on the form. The surety's signature must be notarized, and the bond becomes null and void upon successful completion of all contract obligations. Any changes, extensions, or alterations to the contract terms do not affect the surety's obligations, and the surety waives notice of such modifications. The document requires approval from both the County's CEO/Risk Management and Office of County Counsel.

The bond obligates the contractor to indemnify and defend the County while performing all work as specified in the underlying contract. The penal sum amount is to be determined based on the contract price at a specified rate per thousand dollars. California Corporations Code Section 313 requirements apply to corporate signatories, requiring either two authorized officers (chairman/president/vice president plus secretary/assistant secretary/CFO/assistant treasurer) or one officer with written evidence of authority. The County reserves the right to recover all costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation, which shall be taxed as costs and included in any judgment rendered against the contractor or surety.
