About this file

This is a Faithful Performance Bond document for the County of Orange, California, establishing the bonding requirements for contractors awarded work by the County's Sheriff-Coroner department. The bond secures the contractor's obligation to perform all work in accordance with contract terms, conditions, and specifications. The bond requires the contractor to furnish a surety company authorized to conduct business in California, with the penal sum amount to be specified based on the contract price. The document specifies that the bond premium is calculated at a stated rate per thousand dollars of the contract price, with the exact premium amount to be inserted upon execution.

The bond obligates the principal contractor and surety jointly and severally to indemnify, defend, and hold harmless the County, its officers, and agents from any failure to perform contractual obligations. The surety waives notice of any contract modifications, extensions, time changes, or specification alterations, remaining fully liable regardless of such changes. The bond requires notarization of the surety representative's signature with the certificate of notarization attached to the document, and the surety company name must be typed or stamped above the signature line. The document must be approved by both the County's CEO/Risk Management and the Office of the County Counsel, with signatories required to comply with California Corporations Code section 313 regarding corporate authorization requirements. All costs and reasonable expenses incurred by the County in enforcing the bond obligation shall be included as taxable costs in any judgment rendered.
