About this file
This is a Faithful Performance Bond template document for the County of Orange, California, designed to ensure contractor compliance with contract obligations. The bond secures the contractor's faithful performance of work as outlined in the underlying contract and requires the principal contractor and surety company to be jointly and severally liable to the County in a specified penal sum. The document establishes that the bond remains in full force unless the contractor meets all covenants, conditions, and agreements within the contract terms and performs work according to specifications and timeline requirements. The bond includes provisions that the surety waives notice of any contract modifications, extensions, alterations, or additions, and the County reserves the right to recover all costs and reasonable expenses incurred in enforcing the bond obligation, which shall be taxed as costs in any judgment rendered. Contractor signature requires compliance with California Corporations Code section 313, mandating either dual signatures from specified corporate officers or a single officer signature accompanied by written corporate authority documentation.
The performance bond premium is calculated at a stated rate per thousand dollars of contract price, with the surety's signature requiring notarization and attachment of the notarization certificate to the document. County approval is required from both the CEO/Risk Management office as to surety and limits and the Office of the County Counsel as to form. For the specific Recognition Plaques and Awards procurement cited, successful bidders must maintain $1,000,000 per occurrence commercial general liability coverage and $1,000,000 automobile liability coverage, with the contract commencing May 28, 2026, for an initial three-year term with a two-year renewal option subject to Board of Supervisors approval. The bond document serves as a standard protective mechanism ensuring contractor performance and financial accountability for the County's procurement obligations.
