About this file

This is a Faithful Performance Bond template document issued by the County of Orange, California for use in contract performance guarantees. The bond serves as a security mechanism requiring contractors to demonstrate financial commitment to fulfilling contractual obligations with the County. The document establishes a standardized format whereby contractors and their sureties jointly and severally bind themselves to the County in a specified penal sum, ensuring faithful performance of all contract terms, conditions, and agreements. The bond requires notarization of the surety representative's signature and formal approval by both the County's Risk Management (CEO level) and Office of the County Counsel before execution. The template accommodates variable premium rates charged by surety companies, expressed as a rate per thousand dollars of the contract price.

The bond document incorporates broad protective provisions for the County, including waiver of notice requirements by the surety regarding any contract modifications, extensions, alterations, or specification changes. The surety's obligation remains unaffected by such changes and extends to include the County's cost and reasonable expenses for enforcing the bond, which shall be taxed as costs in any judgment rendered. Corporate signatory requirements comply with California Corporations Code section 313, mandating either dual signatures from specified officer classes or single-signature authority evidenced by corporate resolution. For the related Utility Trailers procurement, the County requires faithful performance bonds upon award, with the total contract value not to exceed $74,757.50 and a one-year term with no automatic renewal.
