About this file

This is a Faithful Performance Bond document issued by the County of Orange, California, for use in a Utility Trailers procurement contract managed by OC Public Works. The bond serves as a security instrument requiring contractors to guarantee faithful performance of contract obligations. The bond is structured as a penal sum agreement whereby the Principal (contractor) and Surety (bonding company) jointly and severally bind themselves to the County, with the specific penal amount to be determined based on the contract price at a stated premium rate per thousand dollars. The document requires notarization of the Surety representative's signature and specifies that the Surety Company name must be typed or stamped above the signature line. The bond remains in full force regardless of any changes, extensions, alterations, or additions to the underlying contract terms, specifications, or work scope, with the Surety waiving notice of such modifications.

The bond obligates the contractor to perform all covenants, conditions, and agreements specified in the contract and to indemnify and defend the County and its officers and agents against claims. The County must approve the bond as to both form (through the Office of the County Counsel) and as to surety and limits (through the CEO/Risk Management). Enforcement costs and reasonable expenses incurred by the County in successfully enforcing the bond obligation are recoverable and taxable as costs in any resulting judgment. Signature authority requirements follow California Corporations Code section 313, requiring either two corporate officers with specific titles or a single officer with written evidence of binding authority. The bond document includes blank fields for the bond number, premium amount, contract date, contractor information, Surety information, penal sum amount, and execution date.
