About this file

This is a Performance Bond template document for the County of Orange, California, used to ensure faithful performance by contractors on County contracts. The bond requires contractors to secure a surety company to guarantee completion of contracted work according to specifications and timelines. The bond document establishes a penal sum amount (to be filled in based on contract value) and requires joint and several liability between the principal contractor and the surety. The bond obligates the contractor to indemnify and defend the County against losses resulting from non-performance, with the surety waiving notice of any changes, extensions, or alterations to the underlying contract terms. County approval signatures are required from both the CEO/Risk Management and the Office of the County Counsel, and the surety representative's signature must be notarized with the certificate of notarization attached to the bond document.

For the Fresh Produce contract opportunity (IFB #060-2995502-MB2) referenced in relation to this bond template, contractors must provide a Performance Bond and Labor and Material Payment Bond with penal sums determined based on estimated contract value. The bond requirements are standard compliance measures for this procurement, which involves supplying fresh produce to four Orange County Sheriff-Coroner Department facilities with deliveries required at least twice weekly from May 6, 2026, through May 5, 2028, with two optional one-year renewal periods. Questions must be submitted by February 26, 2026, at 4:00 p.m., with bids due March 12, 2026, at 4:00 p.m. through the County's eProcurement Portal, and bid validity extends for 365 days. A five percent preference deduction (maximum $100,000) applies to certified Orange County Local Small Business or Disabled Veteran Business Enterprise bidders, with pricing firm for the initial contract year and no price increases permitted during that period.
