About this file

This is a Performance Bond template document for the County of Orange, California, establishing the bonding requirements for contractors engaged by the County. The bond serves as a guarantee of faithful performance of contract obligations and requires the Principal (Contractor) and Surety to be jointly and severally liable to the County in a penal sum to be specified. The bond obligates the Principal to perform all covenants, conditions, and agreements as outlined in the underlying contract, with the Surety waiving notice of any changes, extensions, alterations, or additions to contract terms, work specifications, or scope modifications. The document requires notarization of the Surety representative's signature and includes approval authority from both the County's CEO/Risk Management and Office of the County Counsel.

In the context of the Throw Phone procurement (IFB #IFB-060-3007501-CLM), this Performance Bond template would be required from the awarded Contractor in an amount equal to or exceeding the estimated contract value, with surety provided by a company authorized to conduct business in California. The bond protects the County by ensuring contractor performance of the throw phone system procurement, installation, training, and maintenance obligations. Additionally, a Labor and Material Payment Bond of equal or greater value to the estimated contract amount would be required. The bond premium, calculated at a specified rate per thousand of the contract price, is the responsibility of the contractor. Successful bid submission and contract award require compliance with all bonding requirements prior to contract execution.
