About this file
This is a Faithful Performance Bond template for the County of Orange, California, for use in connection with contract awards. The bond form establishes the requirements for contractors to provide performance security guaranteeing faithful execution of their contract obligations with the County. The document serves as a binding agreement between the principal (contractor), surety company, and the County, wherein the surety pledges to ensure the contractor's compliance with all terms, conditions, and specifications outlined in the underlying contract. The bond becomes null and void upon successful performance of all contract requirements; otherwise, it remains in full force. The template allows for flexibility in bond amounts, premium rates, and contract-specific details to be inserted as needed for individual procurements.
The bond requires the surety's signature to be notarized, with a certificate of notarization attached to the document. The penal sum (bond amount) must be specified in the form, with the surety calculating premiums based on the stated rate per thousand dollars of the contract price. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms, work specifications, or performance requirements. The County reserves the right to recover all costs, reasonable expenses, and fees incurred in enforcing the bond obligation, which are taxable as costs in any judgment rendered. Corporate signatories must comply with California Corporations Code Section 313 requirements, either by obtaining signatures from two specified officers or providing written evidence of single-officer authority through corporate resolution. Approval from both the County's CEO/Risk Management office and Office of the County Counsel is required before execution.
