About this file

This is a Faithful Performance Bond template for the County of Orange, California in connection with a Refrigeration System Maintenance and Repairs contract. The bond document establishes the contractual obligations between the County, the Principal (contractor), and the Surety (bonding company) to ensure faithful performance of the awarded contract. The Principal and Surety are jointly and severally liable to the County in a penal sum to be specified, with the bond remaining in full force regardless of any changes, extensions, alterations, or additions to the underlying contract terms, specifications, or work scope. The bond requires notarization of the Surety's representative signature and typed or stamped identification of the Surety company name above the signature line.

The premium charged on the bond is calculated at a specified rate per thousand dollars of the contract price. The bond obligates the Principal to perform all covenants, conditions, and agreements in the contract at the specified time and manner, and to indemnify and defend the County with approved counsel while saving it harmless from liability. In addition to the face amount of the bond, the County may recover reasonable costs, expenses, and fees incurred in enforcing the obligation, which shall be taxed as costs and included in any judgment rendered. The bond must be approved as to form by the Orange County Office of the County Counsel and as to surety and limits by the CEO/Risk Management. Corporate signatories must comply with California Corporations Code section 313, requiring either two authorized officers or one officer with documented authority to bind the corporation.
