About this file
This is a Performance Bond template document for the County of Orange, California, establishing the bonding requirements for contractors entering into service agreements with the County. The bond secures the faithful performance of contract obligations by requiring the Principal (contractor) and Surety (bonding company) to be jointly and severally liable to the County for the penal sum specified in the bond. The document requires that the Surety representative's signature be notarized, with the certificate of notarization attached to the bond. The bond remains in full force and effect unless the Principal fully performs all covenants, conditions, and agreements stipulated in the underlying contract according to the specified terms and manner. The Surety waives notice of any changes, extensions, alterations, or additions to the contract terms, work specifications, or performance requirements.
The bond template applies to the County of Orange's Offset Printing Supplies procurement (IFB 031-2748704-CM), which requires contractors to furnish both a Labor and Material Payment Bond and a Performance Bond. The bond amount is determined based on the contract price, with the premium calculated at a specified rate per thousand dollars of the contract value. The bond obligates the Surety to indemnify and defend the County while holding it harmless from any losses related to contractor performance failures. The document must be approved by the County's CEO/Risk Management and the Office of the County Counsel. Corporate signatories must comply with California Corporations Code section 313 requirements, whereby either two designated corporate officers or a single officer with documented authority to bind the corporation must execute the bond.
