About this file

This is a Performance Bond document required by the County of Orange, California for contractors entering into service agreements with the County. The bond serves as a faithful performance guarantee, obligating the principal contractor and surety to ensure completion of contracted work according to specifications and timelines. The bond is structured as a joint and several liability instrument, with the penal sum to be determined based on the contract price at a specified rate per thousand dollars. The surety must be authorized to conduct business in California, and the bond becomes null and void upon satisfactory completion of all contract obligations. The document requires notarization of the surety representative's signature and compliance with California Corporations Code section 313, which mandates either dual signatures from specified corporate officers or a single officer signature accompanied by written evidence of authority.

The bond obligates the surety to indemnify and defend the County against losses resulting from the contractor's failure to perform, with the County entitled to recover reasonable costs and attorney fees incurred in enforcing the bond obligation. The surety waives notice of any contract modifications, time extensions, or specification changes, remaining liable regardless of such alterations. Execution of the bond requires approval from the County's CEO/Risk Management and Office of County Counsel. The premium charged for the bond is variable and calculated based on the contract price, with specific rates to be inserted by the contracting parties. This bond document is a standard requirement for the Custom Outfitting for Utility Vehicle procurement (Solicitation 060-2933102) issued by the Orange County Sheriff-Coroner Department.
