About this file

This is a Performance Bond form template issued by the County of Orange, California, designed for use by contractors awarded county contracts. The bond serves as a faithful performance guarantee requiring the principal contractor and an authorized surety company to jointly and severally guarantee completion of contract work according to specified terms and conditions. The bond amount is set at the contract price, with the surety company required to be duly authorized to conduct business under California law. The bonding premium is charged at a specified rate per thousand dollars of the contract price, and the surety waives notice of any changes, extensions, alterations, or additions to the contract terms, specifications, or work scope. The bond becomes null and void upon successful performance of all contract covenants and conditions; otherwise, it remains in full force. The County reserves the right to recover all costs and reasonable expenses, including attorney fees, incurred in enforcing the bond obligation, which are taxable as costs in any judgment rendered.

The Performance Bond requires notarized signatures from the surety representative and approval by both the County's CEO/Risk Management division and the Office of the County Counsel. California Corporations Code section 313 compliance is mandatory, requiring either dual corporate officer signatures with specific titles or a single officer signature accompanied by written corporate authority documentation such as a corporate resolution. The bond is structured as a secured obligation with the penal sum amount to be completed by the awarding agency, and the surety company name must be typed or stamped on the document. This form template applies to the Document Composition & Distribution System contract opportunity with the Orange County Registrar of Voters, which requires full implementation prior to April 1, 2026, with a firm fixed-fee pricing structure subject to Board of Supervisors approval if exceeding $200,000 annually or $1,000,000 total contract value.
