About this file
This is a Performance Bond form issued by the County of Orange, California, required for contractors entering into service agreements with the county. The bond guarantees the faithful performance of contract obligations by the principal contractor, with a surety company providing financial security. The bond document establishes joint and several liability between the contractor and surety to the county in a penal sum amount to be specified, ensuring compliance with all contract terms, conditions, and specifications. The document requires notarized signatures from both the contractor and surety representative, along with approval from the county's CEO/Risk Management and Office of the County Counsel. The bond remains in effect for any modifications, extensions, or alterations to the underlying contract and includes provisions for the county to recover enforcement costs and expenses as part of any judgment.
In the context of the County of Orange Probation Department's hair care services solicitation, this performance bond will be required from the winning bidder to guarantee fulfillment of the three-year contract beginning February 1, 2026, with potential two-year renewal options. The bond must comply with California Corporations Code Section 313 regarding corporate signatory requirements, with corporate contractors providing either dual signatures from specified officers or evidence of single-officer authority through corporate resolution. The surety company must be duly authorized to transact business in California, and all notarization certificates must be attached to the executed bond document prior to contract award and commencement of hair care services at the three juvenile facilities.
