About this file
This is a Faithful Performance Bond template document issued by the County of Orange, California, for use in securing contract performance. The bond serves as a guarantee that a contractor will fulfill all obligations, covenants, conditions, and agreements specified in their awarded contract with the County. The bond protects the County against contractor non-performance and requires the contractor to indemnify, defend, and hold harmless the County, its officers, and agents. The surety company executing the bond becomes jointly and severally liable with the contractor for faithful contract performance. Signature requirements for the bond include notarized execution by the surety representative and typed or stamped identification of the surety company name. County approval of both the surety and bond limits must be obtained from the County's CEO/Risk Management office, and the document must receive legal approval from the Office of the County Counsel.
The bond's penal sum amount and premium rate are to be specified by the County and calculated as a percentage of the total contract price. The surety waives notice of any changes, extensions, alterations, or additions to contract terms, specifications, or work scope, remaining obligated regardless of such modifications. Additionally, the County retains the right to recover all costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation, which are taxable as costs and recoverable in any judgment. Corporate signatories must comply with California Corporations Code Section 313, requiring either dual signatures from specified officer positions or single signature accompanied by evidence of corporate authority. This bond template is applicable to the County of Orange's solicitation for Aftermarket Kitchen Equipment and Repairs, with bids due by December 16, 2025.
