About this file

This document is a Faithful Performance Bond form required by the County of Orange, California for contractors entering into service agreements with the County. The bond template establishes the legal framework whereby a contractor and surety company jointly guarantee faithful performance of contract obligations to the County. The bond is structured as a penal sum agreement, with the specific bond amount, premium costs, contract dates, contractor information, and surety company details to be completed on a case-by-case basis. The form requires notarized signatures from the surety representative and approval from both the County's CEO/Risk Management and the Office of the County Counsel. The bond remains in full force unless the principal satisfies all covenants, conditions, and agreements specified in the underlying contract and indemnifies and defends the County as required.

The bond obligates the surety to cover not only the penal sum amount but also all reasonable costs and expenses incurred by the County in enforcing the bond obligation, which are to be included as taxable costs in any judgment rendered. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms or specifications, confirming that such modifications do not affect its liability. Corporate signatories must comply with California Corporations Code Section 313 requirements, whereby either two officers of specified ranks must sign or a single officer may sign with written evidence of authority. This bond form applies to the County of Orange Sheriff-Coroner's solicitation for Moving and Storage Services of Levied Property, which is being conducted through the County's electronic eProcurement Portal with bids submitted exclusively through that online system.
