About this file
This is a Faithful Performance Bond template for the County of Orange, California, used to guarantee contractor performance on county contracts. The bond is a standard form requiring a principal contractor and authorized surety company to jointly and severally bind themselves to the county in a penal sum amount to ensure faithful performance of contract obligations. The surety must be authorized to transact business in California, and the surety representative's signature must be notarized with the certificate of notarization attached to the document. The bond becomes null and void upon successful completion of all contract covenants, conditions, and agreements as specified in the underlying contract between the county and the principal contractor.
The bond includes provisions that any changes, extensions of time, alterations, or additions to contract terms do not affect the surety's obligations, and the surety waives notice of such modifications. The County of Orange Office of County Counsel must approve the bond as to form, and the County's CEO or Risk Management representative must approve it as to surety and limits. Corporate signatories are subject to California Corporations Code section 313 requirements, which mandate either dual signatures from specified officer positions or a single signature accompanied by written evidence of authority. The bond premium is calculated at a specified rate per thousand of the contract price, and the county may recover all reasonable costs and expenses incurred in enforcing the bond obligation, including attorney fees, as taxed costs in any resulting judgment.
