About this file
This is a Faithful Performance Bond template from the County of Orange, California, designed for use with the County's Temporary Heating, Ventilating and Air Conditioning Rental Services contract. The bond document establishes the bonding requirements that successful bidders must meet prior to contract execution. The performance bond obligates the contractor and surety to ensure faithful performance of all contract terms, conditions, and agreements. The bond amount, premium rate, contract date, contractor information, and surety details are to be completed upon contract award. The surety must be authorized to transact business under California law and must execute the bond with a notarized signature.
The bond serves as a guarantee mechanism requiring the contractor and surety to indemnify and defend the County against losses resulting from non-performance or breach of contract. All costs, reasonable expenses, and fees incurred by the County in enforcing the bond obligation are recoverable as part of any judgment rendered. The surety waives notice of any changes, extensions of time, alterations, or additions to contract terms and specifications. Corporate signatories must comply with California Corporations Code Section 313, requiring either two authorized officers to sign or one officer with written evidence of authority to bind the corporation. The Surety's signature must be accompanied by a certificate of notarization, which must be attached to the executed bond document. Approval of the surety and bond limits is required by the County's CEO or Risk Management representative, and approval as to form is required by the Orange County Office of the County Counsel.
