About this file
This is a Faithful Performance Bond document for the County of Orange, California, required for contractors entering into service agreements with the County's Sheriff-Coroner department. The bond serves as a financial guarantee that the principal contractor will faithfully perform all obligations outlined in the underlying contract, including maintaining compliance with all covenants, conditions, and agreements specified in the contract terms and any authorized alterations thereto. The bond obligates the contractor and surety to indemnify, defend, and hold harmless the County, its officers, and agents from any losses or liabilities arising from non-performance.
The performance bond is structured as a penal sum obligation, with the specific bond amount to be determined based on the contract price at a stated rate per thousand dollars. The surety must be authorized to transact business under California law, and the surety's representative signature must be notarized with the certificate of notarization attached to the document. The bond remains in effect regardless of any contract modifications, extensions, or specification changes, and the surety waives notice of such alterations. Corporate signatories must comply with California Corporations Code section 313 requirements, either with dual signatures from specified officers or a single officer signature accompanied by written corporate authority documentation. The County's approval of both the surety and bond limits, as well as approval as to legal form by the County Counsel's Office, must be documented on the bond before execution.
