About this file

This is a Performance Bond template document issued by the County of Orange, California, establishing the requirements and conditions for contractors to provide faithful performance bonds in connection with county contracts. The bond obligates both the principal contractor and the surety company to ensure full performance of contracted work in accordance with all specified terms, conditions, and agreements. The bond serves as a guarantee to the County that the contractor will comply with all contract requirements, maintain agreed-upon timelines, and adhere to specifications, with the surety assuming joint and several liability for the contractor's obligations. The document requires that the surety representative's signature be notarized and accompanied by a certificate of notarization, and it specifies that the surety company name must be typed or stamped above the signature line.

The bond premium is charged at a specified rate per thousand dollars of the contract price, with the total penal sum amount to be determined based on the individual contract value. The surety waives notice of any changes, extensions, alterations, or additions to contract terms, specifications, or work scope, acknowledging that such modifications do not affect its bonding obligations. The County is entitled to recover all costs, reasonable expenses, and attorney fees incurred in enforcing the bond obligation, which may be included as costs in any resulting judgment. Corporate signatories must comply with California Corporations Code section 313, requiring either signatures from two designated officers or a single officer with written evidence of authority to bind the corporation. This performance bond template is applicable to the County of Orange's laser print check stock procurement, as well as other county contracts requiring faithful performance guarantees.
