About this file
This is a Faithful Performance Bond document for the County of Orange, California, required as part of a contract award for Evofinder Extended Warranties with the Sheriff-Coroner Department. The bond template establishes the framework for contractors to provide surety coverage, ensuring faithful performance of contract obligations. The specific contract details, including the exact contract date, contractor name and address, surety company information, bond number, premium rates, and penal sum amount, are to be completed upon contract execution. The bond serves as a guarantee that the principal contractor will comply with all covenants, conditions, and agreements specified in the underlying contract and any amendments thereto, with performance to be completed in the time and manner stipulated.
The performance bond requires the surety to indemnify, defend, and hold harmless the County of Orange, its officers, and agents from any breach of contract. The surety waives notice of any changes, extensions, alterations, or additions to contract terms, specifications, or work scope. The bond must be executed with notarized signatures from both the contractor and surety representative, with corporate signatories required to comply with California Corporations Code Section 313 requirements. The County's Office of the County Counsel must approve the bond as to form, and the CEO or Risk Management office must approve it as to surety and limits. All costs and reasonable expenses incurred by the County in enforcing the bond obligation, including attorney fees, are to be taxed as costs and included in any resulting judgment.
