About this file
This is a Faithful Performance Bond template document issued by Orange County, California, for use in conjunction with traffic marking services contracts. The bond serves as a guarantee that the contractor will faithfully perform all obligations outlined in the underlying contract between the County of Orange, Public Works Department, and the awarded bidder. The performance bond requires the contractor (Principal) and a licensed surety company authorized to conduct business in California to jointly and severally bind themselves to the County for the penal sum specified in the contract, ensuring compliance with all covenants, conditions, and agreements established in the underlying contract terms.
The bond requires that the surety representative's signature be notarized with the certificate of notarization attached to the document, and the surety company name must be typed or stamped above the signature line. The bond stipulates that the surety waives notice of any changes, extensions of time, alterations, or additions to contract terms, work specifications, or schedule. Additionally, the bond obligates the surety to indemnify and defend the County and its officers and agents, with all enforcement costs, reasonable expenses, and attorney fees to be included in any judgment rendered against the surety. Corporate signatories must comply with California Corporations Code section 313, requiring either dual signatures from specific officer categories or a single officer signature accompanied by written evidence of authority, such as a corporate resolution. Approval as to form must be obtained from the Orange County Office of the County Counsel, and approval as to surety and limits must be obtained from the County's CEO/Risk Management.
