About this file

This is a Performance Bond document required by the County of Orange, California for contract execution. The bond serves as a faithful performance guarantee obligating the contractor and surety to ensure completion of work according to contract specifications and terms. The bond is jointly and severally binding on the principal (contractor), surety company, and their respective heirs, executors, administrators, successors, and assigns. No formal bidders' conference or site visit is specified in the related solicitation for the Canycom equipment procurement (IFB #012-3039203-ME). All bids are due by May 15, 2026, at 2:00 PM through the County's electronic eProcurement Portal. The contract term is one year from execution with no automatic renewal unless approved by the County Board of Supervisors. The awarded contractor must execute the contract within seven days of County notification.

The performance bond requires the contractor to indemnify and defend the County with County-approved counsel and maintain the bond's full force despite any contract modifications, time extensions, alterations, or specification changes. The surety waives notice of such changes and agrees that no alterations shall affect its obligations. The bond must include a notarized signature from the surety representative with the notarization certificate attached, and the surety company name must be typed or stamped above the signature line. Additionally, the contractor must provide both a Performance Bond and Labor and Material Payment Bond with surety companies authorized to conduct business under California law. The related contract requires comprehensive insurance coverage including commercial general liability ($1,000,000 per occurrence/$2,000,000 aggregate), automobile liability ($1,000,000 combined single limit), and workers' compensation at statutory limits with employers' liability insurance ($1,000,000 per accident). Payment will be made in arrears within 30 days of receipt of acceptable invoices under a firm fixed-fee agreement with no price increases permitted during the one-year contract term.
