About this file
This is a Contractor's Performance Surety Bond template issued by the City of Palo Alto, California, establishing the financial security requirements for contractors undertaking public improvement projects. The bond secures the principal contractor's faithful performance of their agreement with the City, requiring the contractor and an admitted surety to bind themselves jointly and severally for the penal sum specified in the underlying contract. The bond applies to the UCC Generator Replacement Project, which involves the removal and replacement of the existing 165kW diesel generator system, underground fuel tank, fuel lines, and day tank with a new 175kW diesel generator featuring a 96-hour UL142 fuel belly tank, along with installation of an 800-amp automatic transfer switch, 600-amp triple switch with enclosure, and associated electrical infrastructure modifications at 3241 East Bayshore Road. The mandatory pre-bid meeting is scheduled for May 6, 2025, with electronic bid submissions due June 30, 2025, at 3:00 pm. The project completion timeline is targeted at 120 calendar days with an anticipated start date of July 1, 2025.
The performance bond secures not only the face amount but also includes costs, reasonable expenses, and attorney's fees incurred by the City in enforcing the bond obligations and any liquidated damages for which the principal may be liable. The surety waives notice of any changes, extensions, alterations, or additions to the agreement terms, specifications, or work scope, and waives the provisions of California Civil Code Sections 2845 and 2849. Bidders must possess a valid California Contractor's License (C-10, C-8, or General Contractor B), maintain registration with the California Department of Industrial Relations, and provide 10% bid security. The project is funded through the City of Palo Alto's municipal infrastructure budget and requires compliance with prevailing wage regulations and the 2022 California Building, Fire, Electrical, Mechanical, and Plumbing Codes. A temporary 100kW generator will maintain power during construction, and contractors must obtain necessary permits, coordinate with the city's project manager, conduct testing and commissioning, and properly dispose of existing equipment.
