Question 34
Section H Special Contract Requirements; Section H.7, PBGC 52.237-7002 Fitness
Determination (April 2016) – Paragraphs (c)(1) and (d)(1) (pp. 33-34):
Paragraph (c)(1) on page 33: “For U.S. citizens and foreign nationals residing and performing services within the U.S. and its territories the PBGC shall require all contractor (and subcontractor) employees to submit to a background investigation commensurate with the duties and responsibilities of their position as per Homeland Security Presidential Directive 12 (HSPD-12), Title 5 CFR Part 731, Executive Order 13488, and other applicable Federal mandates and guidance.” While our firm conducts a thorough background check upon each employee’s hiring, we prefer to not subject our employees to additional background checks mandated by external parties. Would the PBGC be able to enter into a contract with an offeror that uses its own background investigation forms and complies with its own background investigation procedures?
Answer:
The Clause, PBGC 52.237-7002 Fitness Determination (April 2016) will be removed from the solicitation in its entirety.
Question 35
Section (d)(1) on page 34 says: “The contractor shall ensure all contractor (and subcontractor) employees providing services to PBGC undergo a background investigation. When contractor employees providing services to PBGC are located outside the US or its territories, and do not possess US Citizenship or a US Alien Registration Number, their background investigation must be completed by a reputable third party background investigation vendor acceptable to PBGC. Additionally, the cost of each background investigation shall be the responsibility of the contractor.” If an offeror exercises reasonable care in selecting third party background investigation vendors, will PBGC accept the offeror’s evaluation of such vendors?
Answer:
The Clause, PBGC 52.237-7002 Fitness Determination (April 2016) will be removed from the solicitation in its entirety.
