About this file
This document is a Payment Bond form from the City of Napa Public Works Department, dated February 13, 2024, which serves as a legal instrument to ensure payment to authorized claimants for a specific public works project. The form is designed to protect subcontractors, laborers, and material suppliers by guaranteeing that the primary contractor will pay all required wages, materials, and services associated with the project. The bond is executed between the City of Napa, the Contractor, and a Surety company, with the Surety agreeing to cover any unpaid obligations if the Contractor fails to make proper payments.
The Payment Bond is structured under California Civil Code § 9550 and requires the Surety to pay any outstanding amounts related to labor, materials, unemployment insurance, and other work-related expenses. The bond's total value is to be set at a minimum amount determined during contract execution, and it remains in effect until all project payments are completed. The document specifies that any legal disputes will be governed by California law and adjudicated in Napa County Superior Court. The bond includes provisions for notification, waivers, and includes signature lines for the Surety, Contractor, and City approval, with a requirement to attach a notary seal and power of attorney.
