About this file
This is a Payment Bond document issued by the City of Santa Monica in California for a contract awarded in 2017. The bond is executed between the Principal (contractor) and a Surety to secure payment obligations to all persons involved in contract performance, including contractors, subcontractors, laborers, materialmen, and suppliers as defined under California Civil Code Section 9100. The bond amount equals 100 percent of the proposal amount and covers materials, equipment, labor, and any amounts due under the Unemployment Insurance Act. The bond inures to the benefit of all claimants named in Civil Code Section 9100 and grants them the right to bring suit. The bond obligates the Surety to pay reasonable attorney's fees fixed by the Court if suit is brought, with such fees to be awarded and taxed as costs in the judgment.
The Surety waives notice of any changes, extensions, alterations, or modifications to the underlying contract and agrees that such changes do not affect its obligations under the bond. The obligations bind the Surety and its heirs, executors, administrators, successors, and assigns, jointly and severally. The document requires execution by both the Principal and Surety with corporate seals affixed, along with notarial acknowledgment of the Surety and a Power of Attorney. The bond relates to a contract for Microbial Source Tracking (MST) services involving EPA-approved laboratory testing for human, avian, and gull genetic markers using polymerase chain reaction assays for the City of Santa Monica's Water Resources Division.
