About this file
This document provides the Recurring Pasadena Supplements to the Standard Specifications for Public Works Construction (2023 edition), establishing modifications and supplementary provisions applicable to the City of Pasadena's public works projects. The supplements modify the 2021 Edition of the Standard Specifications for Public Works Construction and establish protocols for contractor obligations, project management, payment procedures, and construction standards. Key provisions address contract execution requiring submission of bonds within fifteen calendar days of the Notice of Award, with performance and payment bonds set at 115 percent of contract price for non-federal contracts. The document establishes construction scheduling requirements utilizing critical path method (CPM) scheduling in Primavera P6, Microsoft Project 2010, or equivalent, with mandatory submission of baseline schedules, monthly updates, three-week look-ahead schedules, and time impact analyses for change orders. Contractors must commence mobilization within fifteen calendar days of Notice to Proceed and complete work within specified timeframes, with work hours restricted to 7:00 a.m. to 4:00 p.m. unless authorized otherwise. The supplements establish liquidated damages at $500 per calendar day for schedule delays, mandatory pre-construction meetings, and requirements for permits, subcontractor compliance, and insurance documentation.
The supplements establish detailed payment procedures with five percent retention withheld from progress payments until project completion, with final payment due within thirty calendar days of receipt of final pay application. For extra work, labor markups are set at twenty percent, materials at fifteen percent, equipment rental at fifteen percent, and other items at fifteen percent, with subcontractor work subject to additional markups of ten percent on the first five thousand dollars and five percent on excess amounts. Force account work requires daily documentation signed by both the City Inspector and Contractor, with extra work bills submitted within three weeks of completion. The document addresses tree protection obligations referencing the City's Tree Protection Ordinance, requires compliance with prevailing wage standards, apprenticeship requirements under California Labor Code Section 1777.5, and mandates adherence to safety regulations including Pasadena Municipal Code noise restrictions limiting operations to specified hours and noise levels of eighty-five dBA. Additionally, the supplements require contractors to maintain all records for three years and make them available for City audit, establish a five working day response timeline for Requests for Information, and impose a holiday moratorium on excavation and construction from November 15 through January 3 in business districts and December 15 through January 3 citywide.

PART 1 - GENERAL PROVISIONS
SECTION 1 - GENERAL
1-1 GENERAL
Subsection 1-1 is hereby supplemented with the following paragraph:
Where a location is not specified with the words shown, specified, or described, interpret:
1. Shown as shown on the plans.
2. Specified as specified in the specifications.
3. Described as described in the Contract. Described means shown, specified, or both.
Headings are included for the purposes of organization and referencing. Inclusion of a heading with no related content, Not Used, or Reserved does not indicate that no specification exists for that subject; applicable specifications may be covered in a general or referenced specification.
Subsection 1-1 is hereby supplemented with the following sub-subsection:
1-1.1 References
A reference within parentheses to a law or regulation is included in the Contract for convenience only and is not a comprehensive listing of related laws and regulations.
Lack of a reference does not indicate that no related laws or regulations exist.
Where the version of a referenced document is not specified, use the most recent version in effect on the date of the Notice Inviting Bids.
Where a section number is referenced without a reference to a document, the reference is to a section of the Standard Specifications as revised by any revised standard specification, Recurring Pasadena Supplements to the Standard Specifications, special provision, or both.
1-2 TERMS AND DEFINITIONS
The following terms of subsection 1-2 are hereby revised as follows:
Agency - The City of Pasadena, California
Board - The City Council of the City of Pasadena, California
Departments - City of Pasadena, Department of Public Works
Engineer - The City Engineer of the City of Pasadena, acting either directly or through properly authorized agents when such agents are acting within the scope of duties entrusted to them.
Force Account - Work ordered on a construction project without an existing agreement on its cost, and performed with the understanding that the contractor will bill the owner according to the cost of labor, materials, and equipment, plus a certain percentage for markup.
1-7 AWARD AND EXECUTION OF THE CONTRACT
1-7.2 Contract Bonds
Paragraph one of sub-subsection 1-7.2 is hereby revised as follows:
The successful bidder shall within fifteen (15) calendar days after the date of receipt of
RS - 11 March 2023
“Notice of Award” sign a Contract and file bonds as required.
Paragraphs three and four of sub-subsection 1-7.2 are hereby revised as follows:
The Contractor shall provide bonds for no less than one hundred fifteen percent (115%) of the Contract Price for the “Payment Bond” (material and labor bond) and the “Performance Bond” on all non-federal contracts.
SECTION 2 - SCOPE OF WORK
2-2 PERMITS
Subsection 2-2 is hereby supplemented with the following paragraph:
Unless otherwise authorized in writing by the Engineer, the Contractor shall comply with all requirements of the permits, and shall maintain or post on the job site, copies of said permits and such other inspection signature cards as may be required by the parties issuing such permits.
The general contractor to whom the contract is awarded and his subcontractors and material men shall comply with the business license requirements of the City as set forth in Title 5 of the Pasadena Municipal Code, entitled Business Licenses and Regulations.
Staging of materials or vehicles within the City of Pasadena will require a license agreement for public right-of-way, and a temporary use permit for private areas.
Payment for securing the appropriate permit or license agreement shall be included in the various related bid items in the Bidder’s Proposal and no additional payment will be made. Permit fees associated with outside agencies will be reimbursed by the City of Pasadena.
2-7 CHANGES INITIATED BY THE AGENCY
Subsection 2-7 is hereby supplemented with the following paragraphs:
The Agency may at any time, as the need arises, order changes within the scope of the work without invalidating the Agreement. If such changes increase or decrease the amount due under the Contract Documents, or in the time required for performance of the work, an equitable adjustment shall be authorized by Change Order. Each approved change order shall be considered as an amendment to the Contract Documents and shall not be considered approved until executed by the Agency.
The Engineer, also, may at any time, by issuing a Field Order, make changes in the details of the work. The Contractor shall proceed with the performance of any changes in the work so ordered by the Engineer unless the Contractor believes that such Field Order entitles him to a change in Contract Price or Time, or both in which event he shall give the Engineer WRITTEN NOTICE thereof within seven (7) days after the receipt of the ordered change. Thereafter the Contractor shall document the basis for change in Contract Price or Time within thirty (30) days.
Engineer has authority to make minor changes in the work, which do not involve extra cost and are not inconsistent with the Contract Documents. Contractor's actions on such instructions, explanations, and drawings of the Engineer means that Contractor agrees that such explanations, instructions, and drawings are within the scope of the work in accordance with the intent of the Contract Documents and does not constitute a basis for modification of the Contract Documents as to price or time. The Contractor shall not execute such changes pending the receipt of an executed Change Order or further instructions from the Agency. The Contract Price may be changed only by a Change Order. The value of any work covered by a Change Order or of any claim for the increase or decrease in the Contract Price shall be determined by one or more of the following methods in the order of precedence listed below:
RS - 12 March 2023
1. Unit prices previously approved.
2. An agreed lump sum.
3. The actual cost for labor, direct overhead, materials, supplies, equipment, and other services necessary to complete the work.
In addition, there shall be added an amount to be agreed upon but not to exceed fifteen percent (15%) of the actual cost of the work to cover the cost of general overhead and profit. The aggregate of all markups for added work performed by a subcontractor, regardless of the number of tiers of subcontractors used, shall not exceed ten percent (10%) on the first five thousand dollars ($5,000) of extra work performed by the subcontractor, and five percent (5%) on work in excess of five thousand dollars ($5,000).
Extra work to be paid for on a force account basis as directed by the Agency’s Representative will be paid for as set forth in Section 2 “Scope of the Work” of the Standard Specifications. The labor surcharge, equipment rental rates, and the right-of-way delay factors for each classification of equipment are listed in the California Department of Transportation (Caltrans) publication entitled Labor Surcharge and Equipment Rental Rates.
Section 2 is hereby supplemented with the following new subsection:
2-11 CONTRACTOR CHANGE ORDER REQUESTS
If the Contractor believes that additional cost or time is involved because of clarifications or instructions the Architect/Engineer issues in response to the Contractor’s notices or requests for information, the Contractor shall submit Change Order Requests as provided in below.
If the Contractor alleges that instructions issued after the date of the Contract will result in increases to the Contract Sum or Contract Time, if latent or unforeseen conditions require modification of the Contract Documents, or the Contractor otherwise becomes aware of the need for or desirability of a change in the Work, a Change Order Request (COR) may be submitted to the Owner in writing, in a format acceptable to Owner, and must specify the reasons for such change, including relevant circumstances and impacts on the Construction Schedule. Contractor shall submit a written price proposal, using an approved format by the City, concurrently with the COR. The Contractor may request additional compensation and/or time through a COR but not for instances that occurred more than five (5) calendar days prior to the COR.
Contractor’s failure to initiate a COR within such period shall be deemed a waiver of the right to adjustment of the Contract Sum or the Contract Time for the alleged change. Any COR that is approved by the Owner will be incorporated in a Change Order or Construction Change Directive. If the Owner determines that the Work in question is not a change, the Owner will issue a Disputed Work Directive, ordering the Contractor to proceed with the Work without delay. If the COR is denied but the Contractor believes that it does have merit, the provisions of subsection 2-10 shall govern.
SECTION 3 - CONTROL OF THE WORK
3-3 SUBCONTRACTORS
Subsection 3-3 is hereby supplemented with the following paragraph:
The Contractor shall provide all necessary information related to the Contract Provisions, Plans, and Specifications to all tier levels of subcontractors and such Provisions, Plans, and Specifications shall be binding upon each such subcontractor.
3-4 AUTHORITY OF THE BOARD AND THE ENGINEER
Subsection 3-4 is hereby supplemented with the following paragraphs:
RS - 13 March 2023
The City and any other Federal, State, or local governmental agency, or any of their authorized auditors or representatives, shall have access to, and the right to audit, excerpt, reproduce, and transcribe any of the Contractor's records, to the extent the City deems necessary for any purpose relating to the contract.
Such records include, without limitation, journals, ledgers, records of accounts payable and receivable, profit and loss statements, financial statements, bank statements, invoices, receipts, subcontracts, agreements, notes, correspondence, memoranda, and any other documents required by the City or by the laws or regulations of any Federal, State, or local governmental agency. The Contractor shall maintain and preserve all such records for a period of at least three years after termination of the contract, or until an earlier audit has been completed and accepted by the highest governmental authority involved, and all questions and disputes arising from the audit have been resolved.
Upon written notice by the City, the Contractor shall promptly make all such records available to auditors or other representatives of the City or other governmental agencies.
The Contractor shall also cooperate with such auditors and representatives in auditing, excerpting, reproducing, and transcribing the records.
The Contractor shall maintain all such records within the City of Pasadena. If not, the Contractor shall promptly reimburse the City for all reasonable costs incurred in conducting the audit at a location other than the City of Pasadena, including, but not limited to; expenses for personnel, salaries, private auditors, travel, lodging, meals, and overhead.
3-5 INSPECTION
Subsection 3-5 is hereby modified by the following:
The Contractor shall notify the Engineer at least forty-eight hours (48 hrs.) in advance of the required inspection.
Subsection 3-5 is hereby supplemented with the following paragraphs:
All work requiring a permit(s) is subject to inspection and approval by the Building Inspector assigned to the project by the Planning Department, or the Public Works Inspector assigned to the project by the Engineer.
A building inspection may be scheduled through the online services offered below. The project address, which is found on the title page of the project plans, must be known to schedule an inspection at:

No work shall be done in any area where there is a discrepancy until approval has been given by the Engineer.
RS - 14 March 2023
3-7.2 Precedence of the Contract Documents
The first paragraph of sub-subsection 3-7.2 is hereby modified by the following:
If there is a conflict between any of the Contract Documents, the document highest in the order of precedence shall control. The order of precedence, from highest to lowest, shall be as follows:
a) Permits issued by jurisdictional regulatory agencies
b) Change Orders and Supplemental Agreements; whichever occurs last
c) Contract/Agreement
d) Addenda
e) Bid/Proposal
f) Special Provisions, Notice Inviting Bids, Instructions to Bidders

The last sentence of the second paragraph of sub-subsection 3-7.2 is hereby deleted.
3-8 SUBMITTALS
3-8.1 General
The second paragraph of sub-subsection 3-8.1 is hereby deleted and replaced with the following paragraphs:
Submit action and informational submittals to the Engineer. Action submittals shall be submitted before the start of the affected work to allow for review and corrections without work delays. Except for test samples, obtain the Engineer’s authorization for action submittals before performing work based on them. Except for shop drawings and test samples, allow fifteen (15) days for review. For a revised action submittal, allow the same number of days for review as the original submittal. The Engineer’s authorization or approval of an action submittal does not void any project requirements or Contract part unless explicitly addressed as a contract change.
Submit shop drawings as specified and as otherwise required to control the work.
Drawings and calculations must be signed by an engineer who is registered as a Professional Engineer in the State of California. Allow twenty (20) days for the review. A set of approved shop drawings must be maintained at the job site at all times for review and reference.
To make a change to an authorized drawing, submit drawing as specified for a new submittal. Clearly note all changes. Submittals where revisions are not clearly marked will be returned without further review. After the work shown on the drawings is complete, submit electronic copies of as-built drawings.
Informational submittals include certificates of compliance, manufacturer’s instructions not associated with drawing submittals, notifications, Quality Control (QC) test data, QC test results, and QC evaluation reports. Such submittals shall be provided as related work progresses and before final acceptance of the project.
All submittals shall be accompanied by a letter of transmittal that indicates date of transmittal, submittal and revision number, if applicable, corresponding specification, and description. Any submittal transmitted without a letter of transmittal will constitute an incomplete submittal and shall be returned to the Contractor without further review.
RS - 15 March 2023
3-10 SURVEYING
3-10.1 General
The entire sub-subsection 3-10.1 is hereby deleted and replaced with the following paragraph:

Section 3 is hereby supplemented with the following new subsection:
3-14 REQUESTS FOR INFORMATION (RFI)
When information is needed for interpretation of the Construction Documents, Contractor shall prepare and submit an RFI. The Contractor shall notify Engineer within twenty-four
(24) hours of any issues discovered or clarifications required that may affect the project schedule. Contractor shall allow a minimum of five (5) working days for the response to the RFI. Depending on the complexity of the inquiry, additional information may be requested of the Contractor and a longer duration may be required to procure a response. The Engineer shall notify the Contractor immediately if such circumstances arise.
SECTION 4 - CONTROL OF MATERIALS
4-4 TESTING
The third sentence of the first paragraph of subsection 4-4 is hereby deleted and replaced with the following paragraph:
Unless otherwise specified in the Special Provisions, all initial testing will be performed under the direction of the Engineer, and at no expense to the Contractor. However, the Contractor shall be responsible for the cost of all retesting required after initial testing because of failed tests.
SECTION 5 - LEGAL RELATIONS AND RESPONSIBILITIES
5-3 LABOR
5-3.1 General
The second paragraph of sub-subsection 5-3.1 is hereby deleted and replaced with the following paragraph:
If any subcontractor or person employed by the Contractor shall appear to the Engineer to be incompetent, intemperate, troublesome, or acts in a disorderly or otherwise objectionable manner, he shall be immediately discharged from the project on the requisition of the Engineer, and such person shall not be reemployed on the work. If said individual has an ownership interest in the contracting entity, the Engineer will serve written notice upon the Contractor and the Surety providing the faithful performance bond, in accordance with sub-subsection 6-7.3, Notice of Termination for Default, of the Standard Specifications, demanding complete and satisfactory compliance with the Contract.
5-3.5 Apprentices
Sub-subsection 5-3.5 is hereby supplemented with the following paragraphs:
RS - 17 March 2023
Pursuant to Section 1777.5 of the Labor Code of California, the Contractor is advised that, for prime contracts involving thirty thousand dollars ($30,000) or more and twenty
(20) working days or more; or contracts with specialty contractors not bidding for work through a general prime contractor, and involving two thousand dollars ($2,000) or more and five (5) working days or more, the following applies:
In submitting a bid, the Contractor certifies his proposed compliance and compliance of any subcontractor with the apprenticeship standards requirements for all apprentice-able occupations of Section 1777.5 of the California Labor Code. Award of a contract is hereby expressly made contingent on contemporaneous and continuing compliance in fact with that section, and any failure to comply shall be deemed a material breach of contract. Any questions regarding compliance should be submitted to the Division of Apprenticeship Standards, Department of Industrial Relations of the State of California.
5-7 SAFETY
5-7.1 Work Site Safety
5-7.1.1 General
The following paragraphs shall be inserted between the first and second paragraph of sub-subsection 5-7.1.1:
The Contractor shall perform all work in a safe, competent manner and in accordance with all federal, state, and local statues, regulations, ordinances, rules, and governmental orders.
The Contractor will be solely and completely responsible for the conditions of the job site, including safety of all persons and property during performance of the work. This requirement will apply continuously and not be limited to normal working hours.
Unforeseen conditions may arise which will require that immediate provisions be made to protect the public from danger or loss, or damage to life and property, due directly or indirectly to prosecution of work under this contract. Whenever, in the opinion of the Engineer, a condition exists which the Contractor has not taken sufficient precaution of public safety, protection of utilities and/or protect of adjacent structures or property, the Engineer will order the Contractor to provide a remedy for the condition. If the Contractor fails to act on the situation, the Engineer may provide suitable protection by causing such work to be done and materials to be furnished as, in the opinion of the Engineer, may seem reasonable and necessary.
The cost and expense of all repairs (including labor and materials) as are deemed necessary, shall be borne by the Contractor. All expenses incurred by the Agency for emergency repairs will be deducted from the final payment due to the Contractor.
The following paragraph shall be inserted between the second and third paragraph of sub-subsection 5-7.1.1:
The presence of the Agency, its representatives, or employees is not intended to include inspection of, nor evaluate the adequacy of the Contractor’s safety measures in, or near, the job site. It is the sole responsibility of the Contractor for the conditions of the job site, including safety of all persons and property during performance of the work. This requirement will apply continuously and not be limited to normal working hours.
SECTION 6 - PROSECUTION AND PROGRESS OF THE WORK
6-1 CONSTRUCTION SCHEDULE AND COMMENCEMENT OF THE WORK
6-1.1 Construction Schedule
Sub-subsection 6-1.1 is hereby supplemented with the following paragraphs:
RS - 18 March 2023
The Contractor shall submit his work schedule to the Engineer at the pre-construction meeting. This schedule shall include the items of work, the time frame required, and any other pertinent scheduling information in accordance with Section 6-1, entitled “Construction Schedule and Commencement of Work”, of the Standard Specifications.
This schedule shall be reviewed and accepted by the Engineer before the Contractor will be permitted to begin the work.
The Engineer, Contractor, and Department Park Supervisor shall coordinate the Contractor’s schedule with ongoing department maintenance of the facility. The Contractor shall schedule all work to be done between the hours of 7:00 a.m. and 4:00 p.m., unless otherwise authorized by the Engineer and permitted by sub-subsection 3- 12.3.
Submittal of the Baseline Schedule, and subsequent updates, is understood to be the Contractor’s certification that the submitted schedule meets all the requirements of the Contract Documents, represents the Contractor’s plan on how the work will be accomplished, and accurately reflects the work that has been accomplished and how it was sequenced (as-built logic).
For each schedule, submit:
1. Plotted original time-scale network diagram on a sheet at least 8-1/2 by 11 inches with a title block and timeline in pdf format.
Sub-subsection 6-1.1 is hereby supplemented with the following new sub-subsections:
6-1.1.1 Schedule Format
Use of the critical path method (CPM) to schedule and control project activities is required. Contractor shall prepare and maintain project schedule using Primavera P6, Microsoft Project 2010, or equivalent. On-site work activities must be driven by calendars that reflect Saturdays, Sundays, and all federal holidays as non-work days.
Schedule shall indicate the following:
1. Planned and actual start and completion dates of each work activity, including applicable:
a. Submittal development
b. Submittal review and acceptance
c. Material procurement
d. Contract milestones and constraints
e. Interfaces with outside entities (e.g., utility outages)
f. Erection and removal of falsework and shoring
g. Test periods, inspection
h. Major traffic stage/phase changes
i. Final cleanup, punch-list/closeout activities
2. Proposed order to execute the work
3. Logical links between the time-scaled work activities
4. All controlling activities
5. Legible description of each activity
6. Except for the Start and End Contract milestone activities, no activities shall be open-ended; each activity must have predecessor and successor ties. No activity can have open-start or open-finish (dangling) logic. Minimize redundant logic ties.
7. Duration of at least one (1) working day for each activity
8. Start milestone date as the Notice-to-Proceed date
RS - 19 March 2023
Once an activity exists on the schedule, it must not be deleted or renamed to change the scope of the activity and must not be removed from the schedule logic without approval from the Engineer/Architect. While an activity cannot be deleted, where said activity is no longer applicable to the schedule but must remain within the logic stream for historical record, it can be changed to an inactive task. Document any such change in the milestone’s Notebook, including a date and explanation for the change. The ID number for a deleted activity must not be re-used for another activity.
6-1.1.2 Monthly Schedule Updates
Submit a monthly updated schedule that includes the status of work completed to date and the work yet to be performed as planned.
Contractor may include changes to schedule updates that do not alter a critical path or extend the scheduled completion date from the approved baseline. If any proposed change in planned work would alter the critical path or extend the scheduled completion date, a revised schedule must be submitted within five (5) days of the proposed change.
6-1.1.3 Time Impact Analysis
A Time Impact Analysis (TIA) must be submitted with each cost and time proposal for a proposed change. The TIA must illustrate the influence of each change or delay on the Contract Completion Date or milestone. No time extensions or delay damages shall be granted unless a delay occurs which consumes all available Project Float and extends the Projected Finish beyond the Contract Completion Date. ATIA must be received within a month of the RFI notifying the Agency of each change or delay.
a. Each TIA must be in both narrative and schedule form. The narrative must define the scope and conditions of the change, provide start and finish dates of impact, successor, and predecessor activity to impact period, responsible party, describe how it originated, and how it impacts the schedule. The schedule submission must consist of three native files:
(1) Fragnet used to define scope of the changed condition;
(2) Most recent accepted schedule update as of the time of the proposal or claim submission that has been updated to show all activity progress as of the time of the impact start date; and
(3) The impacted schedule that has the fragnet inserted in the updated schedule and the schedule “run” so that the new completion date is determined.
b. For claimed as-built project delay, the inserted fragnet TIA method must be modified to account for as-built events known to occur after the data date of schedule update used.
c. All TIAs must include any mitigation, and must determine the apportionment of the overall delay assignable to each individual delay. The associated narrative must clearly describe the findings in a chronological listing beginning with the earliest delay event.
(1) Identify types of delays as follows:
(a) Excusable Delay: Force-Majeure (e.g., weather) – Contractor may receive time extension, but time will not be compensable
(b) Inexcusable Delay: Contractor Responsibility – Contractor will not receive time extension
(c) Compensable Delay: Agency Responsibility – Contractor may receive compensable time extension
RS - 20 March 2023
(2) If a combination of any of the delay types outlined above occurs, it is considered Concurrent Delay, which will require an analysis of the facts to determine compensability and entitlement to any time extension under the applicable contract clauses.
d. Unless the Engineer/Architect requests otherwise, only add conformed contract modifications into the Project schedule.
6-1.1.4 Three-Week Look-Ahead Schedule
A three-week look-ahead schedule shall be prepared and issued by the Contractor to provide a more detailed day-to-day plan of upcoming work identified on the Construction Schedule. Update work plans each week to show the planned work for the current and following two-week period. Additionally, include upcoming outages, closures, preparatory meetings, and initial meetings. Identify critical path activities on the three-week look-ahead schedule. The detail work plans are to be bar chart type schedules, maintained separately from the Construction Schedule on an electronic spreadsheet program and printed on 8-1/2 by 11-inch sheets or as directed by the Engineer. Activities must have sufficient level of detail to assign crews, tools, and equipment required to complete the work. Deliver three (3) hard copies and one electronic pdf file to the Engineer/Architect no later than 8:00 a.m. each Monday, and review during the weekly coordination or production meeting.
6-1.2 Commencement of the Work
Sub-subsection 6-1.2 is hereby deleted and replaced with the following paragraphs:
The Contractor shall mobilize within fifteen (15) calendar days after the issuance of a Notice to Proceed and shall diligently execute the work to completion within the time provided in the Bidder’s Proposal. The contract time shall commence upon the day on which work starts or by the fifteenth calendar day following the issuance of a Notice to Proceed, whichever shall occur first.
The Contractor shall not commence work on the job site until work can begin and continue uninterrupted on consecutive working days until the project is completed within the Contract time.
The Contractor shall order all materials necessary for the work specified upon execution of a contract for this project. The period between contract execution and the start of construction will be used to provide the lead-time for the required materials. No additional time will be given for delay in delivery of contractor furnished materials.
The Contractor shall attend a preconstruction meeting during the material procurement period. The contractor’s foreman or superintendent and project manager are required to attend the meeting. Contractor will be required to submit a Project Milestone Schedule, Schedule of Submittals, Preliminary Schedule of Values for Payment, and organizational chart of Key Personnel who will be dedicated to the Project for the duration of the Work.
Contractor shall submit construction schedule with start and completion dates as well as material and equipment procurement delivery dates. Items of significance that can affect the project schedule and progress will also be discussed.
6-2 PROSECUTION OF THE WORK
Subsection 6-2 is hereby supplemented with the following paragraphs:
Where permanent restoration is practicable, such restoration shall be accomplished within ten (10) working days from the time all other required work not precluded by said restoration is completed. If the Contractor further delays permanent restoration, the Engineer may complete the work using City forces or another contractor. All costs including overhead and administration shall be charged against the Contractor and
RS - 21 March 2023 deducted from progress payments.
The following provisions shall be observed in scheduling the work, unless otherwise directed by the Engineer:
1. The Contractor shall place the new concrete no later than three (3) working days after the concrete has been removed, unless stated otherwise in these special provisions.
2. Once started, the Contractor shall continuously work on the project until completion. Other than for inclement weather, work shall not be discontinued unless notification is provided to the City at least seventy-two (72) hours in advance. Such notification of work suspension shall include the exact date when work will be suspended and the date when work will resume.
No work suspension due to material and/or equipment issue. The General Contractor’s Representative must be on the job site at all time.
Subsection 6-2 is hereby supplemented with the following new sub-subsection:
6-2.1 Survey of Existing Conditions
Before starting work, Contractor’s Job Superintendent and the Engineer shall inspect the site and property adjacent thereto. All defects shall be listed. The list shall be signed by said Superintendent and filed with the Agency. When approved by the Engineer, it will release Contractor from liability for any listed defects.
6-3 TIME OF COMPLETION
6-3.1 General
Sub-subsection 6-3.1 is hereby supplemented with the following paragraphs:
All work on a project shall be completed within time specified in the Special Provisions.
Failure to complete the work within this timeframe will result in the imposition of liquidated damages in accordance with subsection 6-9 of the Standard Specifications.
The Contractor shall not commence work on the job site until work can begin and continue uninterrupted on consecutive working days until the project is completed
The Contractor shall order all materials necessary for the work specified upon execution of a contract for this project. The period between contract execution and the start of construction will be used to provide the lead-time for the required materials. No additional time will be given for delay in delivery of contractor furnished materials.
The Contractor shall not be granted additional contract time due to delays caused by their inability to obtain any materials, equipment, or labor, except as authorized by the Engineer. The length of contract time stipulated includes any time which may be required to obtain materials, equipment, and labor, and the Contractor in submitting a bid shall be deemed to have ascertained the availability of materials, equipment, and labor and considered the same in their proposed construction schedule.
Subsection 6-3 is hereby supplemented with the following new sub-subsection:
6-3.3 Holiday Moratorium
Attention is directed to Chapter 12.24 of the Pasadena Municipal Code entitled Excavations, and Board of Directors Policy Statement in Motion 25405, dated September 5, 1967, both incorporated by reference. In general, all streets shall be free and clear of excavations and other construction during the period of November 15 through January 3 for business and commercial districts, and December 15 through January 3 citywide.
RS - 22 March 2023
Accordingly, the Contractor will be required to shut down construction operations which would impede traffic movement during this period unless otherwise directed by the Engineer in emergency situations. Any existing excavations shall be backfilled, compacted, and temporarily repaved before the shutdown date. Bidders should reflect any costs of such shutdown in the various items of the Bidder’s Proposal, and no additional payment will be made therefor.
A map showing the appropriate shutdown period for all locations in the city is available at the Departments website at:
https://www.cityofpasadena.net/public-works/engineering-and-construction/engineering/
6-4 DELAYS AND EXTENSIONS OF TIME
6-4.1 General
The second paragraph of sub-subsection 6-4.1 is hereby deleted and replaced with the following paragraph:
No extension of time will be granted for a delay caused by the inability of the Contractor to obtain materials, equipment, and labor, except as authorized by the Engineer. The length of contract time stipulated includes any time which may be required to obtain materials, equipment, and labor, and the Contractor in submitting a bid shall be deemed to have ascertained the availability of materials, equipment, and labor and considered the same in their proposed construction schedule.
Sub-subsection 6-4.1 is hereby supplemented with the following paragraph:
To request a delay-related time or payment adjustment, submit a Change Order Request. If the Engineer does not receive a Change Order Request notifying the Agency of impending delay or any substantiating Time Impact Analysis within five (5) working days of the event triggering a delay in project completion date, Contractor forfeits the right to request delay-related time or payment adjustment.
6-6 SUSPENSION OF THE WORK
6-6.1 General
Sub-subsection 6-6.1 is hereby supplemented with the following paragraphs:
If the Work is suspended either wholly or in part by the Engineer, the Contractor shall provide for public safety and a smooth unobstructed passageway through the work zone during the suspension. Providing such passageway is force account work. The Agency will make a time adjustment for the suspension due to a critical delay.
However, if work is suspended wholly or in part due to Contractor’s failure to:
1. Fulfill the Engineer’s orders
2. Fulfill a Contract part
3. Perform weather dependent work when conditions are favorable so that weather related unsuitable conditions are avoided or do not occur.
Passageway shall be provided at the Contractor’s expense. The Agency does not make a time adjustment for the suspension.
6-9 LIQUIDATED DAMAGES
The last sentence of the first paragraph of subsection 6-9 is hereby deleted and replaced with the following sentence:
For each consecutive calendar day in excess of the time specified for completion of the
