About this file
This document is a Sole Source Justification Form submitted by the Illinois Department of Natural Resources to sole source a contract to Lyft Bikes and Scooters, LLC for the installation and operation of a Divvy bike sharing station at William Powers State Recreation Area. The contract would be for a term of 3 years with no renewal options, and would generate $1,500 per year in revenue for the state. Lyft Bikes and Scooters, LLC would be responsible for all costs associated with site preparation, maintenance, operations, and restoration. This sole source justification is necessary because Divvy is the only bike sharing service in Chicago that allows for bikes to be rented and returned at different locations, which is a crucial requirement for connecting William Powers State Recreation Area to the broader Divvy network.
There is no cost to the state for this contract, as it is a revenue-generating agreement. The $1,500 per year in revenue is consistent with other similar agreements between Divvy and local government entities. This contract will result in increased visitation to the recreation area and associated indirect revenue from activities like fishing license sales. As Lyft Bikes and Scooters, LLC is the sole provider of the Divvy bike sharing service in Chicago, the state has determined there are no other viable alternatives that can satisfy the requirements.

Requesting Agency/University Natural Resources
Sole Source Justification Form - Part I Section I - General Information
Department/Bureau/Section: Land Management
Need Identified Date: Jul 27, 2021 Supply/Service Need By Date: Mar 1, 2022
Project Title: Bike Sharing Program
Vendor: Lyft Bikes and Scooters LLC
Provide a description of the supplies or services required:
Installation and operation of a Divvy bike sharing station at William Powers State Recreation Area.
Value: Actual Value of Initial Term, this Change Order or Amendment: 4,500
Will this Sole Source amend a Professional or Artistic Services contract? Yes No
*Sole Source may not be used for amendments for Professional or Artistic Services if the amendment would increase the value by more than 5% of the initial award or extend the term by more than 60 days.
Type: New Sole Source
Section II - Proposed Term
One-Time Purchase Term Contract
Estimated Contract Begin Date: Mar 1, 2022
Estimated Contract End Date: Feb 28, 2025
Number of Potential Renewals: 0
Length of Each Renewal in Months:
Total Value of All Renewals:
If a Term Contract, does the term, including renewals, exceed 12 months? Yes No
If yes, provide a detailed justification including any economic benefit received for agreeing to a multi-year term:
The Chicago Department of Transportation has a program called Divvy, which is a bike sharing program. Currently, Lyft Bikes and Scooters, LLC has a contract with the City of Chicago through 1/23/2028, subject to performance metrics to operate the bike sharing program. Should IDNR enter into a multi-year contract with Lyft Bikes and Scooters, LLC, IDNR will receive $1,500/year, $4,500 total for allowing Lyft Bikes and Scooters, LLC to operate the Divvy bike sharing service at William Powers State Recreation Area for three (3) years. The $4,500 value of the contract is total profit for IDNR as Lyft Bikes and Scooters, LLC assumes the full cost of installation, maintenance, operation, security, removal and restoration at the end of the contract. $1,500/year is on par with other executed Siting Agreements between the City of Chicago and the Chicago Park District. Cook County Forest Preserve has also been offered a hosting fee of $1,500/year, although this agreement has not been finalized. If the State were in a position to procure bike sharing services ourselves, the cost-benefit ratio would not be as advantageous for the State in terms of revenue generated and opportunity for our park visitors. Connecting William Powers State Recreation Area, the southernmost connection point for Divvy, to the bike sharing network within the City of Chicago can only be achieved through partnership with Divvy. The bike sharing program will increase visitor attendance, which will result in direct and indirect purchases made at the site. For example, many park visitors attend William Powers State Recreation Area to fish and would need to purchase and IL Fishing License.

Section III - Funding Source Select the type of funding to be used (Check all that apply): State Appropriate Funds Federal Funds Other (Explain):
Divvy is a program of the Chicago Department of Transportation and is expanding its services through a $50 million capital investment by Lyft. As stated in the proposed Site Agreement, Lyft is responsible for all installation, operating, and restoration expenses associated with the proposed hosting station at William Powers SRA. No IDNR funds will be spent on this project. This is a revenue generating contract.
Section IV - Sole Source Justification
This purchase is economically only available from a single source primarily because it is: (If "Other" explain in one sentence)
Divvy is the only bike sharing service in Chicago that will allow bikes to be rented an returned at different locations.
Are there secondary justification(s) for this sole source? Yes No
Section V - Purchase History
Has the Agency or University Purchased these supplies or services in the past? Yes No
Section VI - Business Rationale
1. Provide a detailed explanation of the need for the supplies or services:
Citizens of the City of Chicago are dependent upon a variety of modes of transportation including public transit. Divvy is a program of the Chicago Department of Transportation and is Chicago's public bike sharing system. Bikes can be used for a variety of recreational and commuter needs, just as other public transportation is used. The Divvy bike sharing station will enhance visitors' recreational experience at William Powers SRA as well as provide commuter access to local manufacturing sites. The Divvy bike sharing station will also boost access to the Recreation Area for local residents by establishing connections to and from surrounding community destinations, including the Burnham Greenway, public transit, and residential areas.
2. Provide a list and describe in detail the specifications required to satisfy the need:
• Site preparation – Lyft will pour a 6' X 41' concrete pad located on the south side of the sidewalk on the southeast corner of S. Avenue O and E. 126th Place/South Wolf Lake Blvd. at the park entrance. No existing park structures (entrance sign, fencing) will be disrupted.
The Divvy station will be installed on the concrete pad within the licensed area which has been certified under the comprehensive environmental review process.
• Maintenance – Lyft will maintain the station in good condition and maintain the improved surface of the licensed area in good condition, which may include cleaning, sweeping, trash removal, and snow and ice removal, as required.
• Operations – Lyft will ensure that the self-service bike sharing station has bikes available for rental, and docks available for the end of rental in accordance with the usability standards set forth its service level agreements with the City of Chicago
• Restoration - at the end of the term as set forth in the siting agreement, Lyft will remove the stations and the concrete pad and restore the grass to its prior condition
3. Provide detail explaining the justification selected in Section IV to explain why the requested supplies or services are the only ones available that can satisfy the agency or university requirements?
Divvy is the only bike sharing system in Chicago. As approved by Chicago City Council in April 2019, the vendor is the City of Chicago's only bike sharing system operator. Divvy users are able to rent a bicycle from one station and return it to another station. If IDNR used a different bike sharing vendor, the bikes would have to be rented and returned to William Powers SRA. They could not be rented at William Powers and returned to a Divvy station elsewhere in the City. Connecting William Powers State Recreation Area, the southernmost connection point for Divvy, to the bike sharing network within the City of Chicago can only be achieved through partnership with Divvy.
4. What are the unique features of the supplies or services that are not available in any other product or by any other vendor? Provide specific quantifiable factors/qualifications:
Currently, Divvy is the exclusive self-service bicycle rental for the City of Chicago. Only Divvy bikes can be rented from and returned to the self-service stations. One big selling feature of the Divvy system is that bikes can be rented at one location and returned at another location. Divvy currently has 670+ self-service bicycle rental stations that functions in concert to provide recreational and commuter opportunities. If another vendor were selected the bikes would not be interchangeable with the current Divvy system.
5. Has the Agency or University considered alternative supplies or services to satisfy their need? Yes No
Version 7.01 Page 3 of 5
Bulletin Reference Number 22-422DNR-LNDMG-B-26813
Requesting Agency/University Natural Resources
5a. If no, why weren't alternatives evaluated?
The City of Chicago already has a contract in place with Lyft Bikes and Scooters, LLC. There are no other bike sharing vendors in Chicago. Compatibility with the current program is crucial.
6. Are there resellers or distributors?
Yes No N/A
7. What efforts were made to get the best possible price (i.e. did the agency/university negotiate) and how did you determine the price for this purchase is considered fair and reasonable?
There is no cost to IDNR as this is a revenue generating contract. The revenue rate of $1500/year is consistent with other local and county government agreements for this type of service.
8. Will this purchase obligate the State to this vendor for future purchases such as maintenance, licensing or continuing need?
Yes No
8a. If yes, please provide details regarding future obligations and/or needs:
All maintenance will be performed by Lyft at no cost to IDNR. If the City of Chicago chooses to renew their contract with Lyft Bikes and Scooters, LLC, IDNR would likely consider procuring additional services to continue the bike sharing program at William Powers State Recreation Area.
9. What will be the financial or other impact to the State if this sole source is not approved and a competitive bid is required?
The State would lose out on a revenue generating contract of $1500/year. The Divvy program requires no State funds for set up, operation, and restoration.
10. Is there any additional information you would like to add to justify this sole source?
The Divvy bike sharing program is a service to our constituents that will also benefit IDNR by generating revenue and indirect sales as a result of increased visitation at William Powers State Recreation Area.
