About this file

This is a Sole Source Justification Form from the Illinois Department of Human Services (DHS), specifically the Division of Behavioral Health and Recovery, seeking to contract with Advocates for Human Potential for State Opioid Response Strategic Planning services. The project involves comprehensive evaluation, management of the Illinois Opioid Remediation Advisory Board (IORAB) and Steering Committee, and implementation of the State Overdose Action Plan. The contract is for a one-year term from September 30, 2025, to September 29, 2026, with a total value of $938,125 and no specified renewal options.

The funding for this sole source procurement comes from a federal Substance Abuse and Mental Health Services Administration (SAMHSA) State Opioid Response grant. The justification emphasizes the vendor's unique qualifications, including their previous work in developing the State Overdose Action Plan, managing advisory councils, and providing strategic planning and evaluation services for opioid crisis response programs. The document highlights that in 2023, Illinois experienced 3,502 overdose deaths, representing the first decrease since 2018, and argues that continuing to work with Advocates for Human Potential is critical to maintaining momentum in addressing the state's opioid crisis. The sole source approach is primarily justified by the federal grant's requirement and the vendor's extensive institutional knowledge of the state's opioid response efforts.

If more than 10, or if other comments, explain:

FY24 sole source procurement was 9/30/2023- 9/29/2024 for $1,117,500 for SOR Strategic Planning and Evaluation and Implementation of State Overdose Action Plan on contract 4100184864.

FY25 sole source procurement was 9/30/2024 - 9/29/2025 for $838,125 for State Opioid Response Strategic Planning, Comprehensive Evaluation, IORAB and Steering Committee Management, and Implementation of State Overdose Action Plan on contract 4100202036.

Section VI - Business Rationale

1. Provide a detailed explanation of the need for the supplies or services:

DHS received funds from the federal agency Substance Abuse and Mental Health Services Administration (SAMHSA) Center for Substance Abuse Treatment (CSAT) for the State Opioid Response (SOR) grant, FAIN TI-087748. The purpose of the SOR grants is to support a range of prevention, treatment, recovery support, public education and infrastructure required to address the overdose crisis in Illinois. The DHS/DBHR application named Advocates for Human Potential (AHP) to provide support to DHS in the areas of strategic planning and evaluation of the many programs being implemented as part of the SOR grant. In addition, AHP finalized the State Overdose Action Plan (SOAP) in early 2022 and AHP is now the lead in assisting the state to manage and implement the SOAP. AHP manages all advisory councils and subcommittees associated with implementation of the SOAP. AHP manages the State Opioid Crisis Response Advisory Council on behalf of DHS/DBHR and works with each of its seven subcommittees to implement recommendations and strategies included in the SOAP. In addition, AHP manages the Illinois Opioid Remediation Advisory Board and its committees, whose work must also align with the SOAP and the SOR grant. Lastly, AHP manages the opioid Steering Committee, chaired by Lt. Gov.

Stratton, and all of its work. These last two (2) boards are subject to the open meetings act.

Requesting Agency/University Illinois Department of Human Services

2. Provide a list and describe in detail the specifications required to satisfy the need:

DHS/SUPR funds programs funded by the Federal Grant to respond to the opioid crisis. SAMHSA requires an evaluation of these programs for both effectiveness and efficiency as part of its funding. AHP will conduct a complete evaluation for all of the SOR programs. Additionally, AHP will assist SUPR and the State with implementing the new SOAP, and managing three of its critical Boards working to address the overdose crisis: the State Opioid Crisis Response Advisory Council (the Council); The Illinois Opioid Remediation Advisory Board (IORAB), which manages all of the opioid settlement funds; and the Opioid Steering Committee, chaired by Lt. Gov.

Stratton, which approves all recommendations and funding decisions of the IORAB.

1. Provide key DHS/SUPR staff with evaluation design, plan and timeline for all SOR funded treatment and recovery service programs in compliance with due dates communicated by SUPR.

2. Develop and select information and data collection tools to be utilized in the service program process evaluations and submit all to DHS/SUPR staff for review and approval.

3. Provide key DHS/SUPR staff with periodic update documents and summary reports of the evaluation in compliance with a format and timeline identified by DHS/SUPR.

e. Disseminate information on training opportunities, DHS/SUPR and State overdose-related activities and other relevant materials to Council members on an ongoing basis.

5. Convene and manage the six Council subcommittees (Committees).

a. Convene and facilitate Committee meetings.

b. Work with Chairs to develop meeting agendas and committee goals.

c. Work with Chairs and Committee members to implement and complete activities needed to achieve goals (i.e., ancillary data collection, creating toolkits, surveying stakeholders).

d. Prepare and distribute Committee meeting minutes and other meeting materials.

e. Maintain membership and email distribution lists for each Committee.

f. Disseminate information on training opportunities, relevant DHS/SUPR and State activities and other materials to Committee members.

6. Consult with DHS/SUPR to implement the recommendations of the SOAP that include goals, objectives and metrics developed by Council Committees.

7. Collaborate with DHS/SUPR Director and other key staff to develop timelines to implement SOAP recommendations.

8. Work with key DHS/SUPR staff and Committee Chairs to implement recommended initiatives documented in the SOAP. This includes initiatives assigned to DHS/SUPR and Committees.

Tasks may include:

a. Convening meetings to develop work plans and data collection tools.

c. Conducting focus groups and key informant interviews.

d. Conducting literature reviews and preparing reports.

9. Collect/compile data on SOAP recommendations and metrics.

10. As directed by DHS/SUPR, provide intermittent analysis and updates to SOAP implementation plan and provide updates to key DBHR leadership in order to continuously monitor and improve SOAP implementation and progress towards State goals.

11. Prepare semi-annual reports that document implementation of SOAP recommendations and metrics, Department of Public Health (DPH) overdose data, and new challenges impacting the overdose crisis and SOAP recommendations.

a. Present drafts of SOAP implementation reports to DHS/SUPR key staff for review and approval.

b. As directed by DHS/SUPR, present drafts of SOAP implementation reports to leadership/key staff of State agencies listed in the SOAP DPH, Healthcare and Family Services (HFS), Department of Children and Family Services (DCFS), Illinois Department of Insurance (IDOI), Illinois Criminal Justice Information Authority (ICJIA), Illinois Department of Corrections (IDOC), and Illinois Department of Juvenile Justice (IDJJ) for review and approval.

c. Prepare and disseminate final versions of SOAP implementation reports.

Requesting Agency/University Illinois Department of Human Services

3. Provide detail explaining the justification selected in Section IV to explain why the requested supplies or services are the only ones available that can satisfy the agency or university requirements?

For another consecutive year, the DHS SOR SAMHSA grant application named Advocates for Human Potential (AHP) to provide Advisory Council meeting staffing support, to conduct an evaluation of the multiple programs supported by the SOR grant, and to implement the State Overdose Action Plan for the State. The DHS Division of Behavioral Health and Recovery (DBHR) developed the application for the formula grant award and the budget was approved by the DHS clearance process. AHP has successfully provided many of these services in support of previous SOR grants that were previously awarded to DBHR. AHP wrote the SOAP that was released in early 2022 and is now the best choice to manage continuous analysis and implementation of the SOAP through various agencies, councils, and boards in the state whose work must align with the SOAP. AHP is familiar with the calendaring, open meetings act requirements, deadlines, and various advisory council and board members whose critical work must all be managed in order to comply with the grant, implement the SOAP, and assist DBHR with addressing the opioid crisis through these various boards and councils.

4. What are the unique features of the supplies or services that are not available in any other product or by any other vendor? Provide specific quantifiable factors/qualifications:

The Illinois SOR grant application references the Illinois Statewide Opioid Crisis Response Advisory Council which has been convening since January 2017 to speak to the numerous initiatives and programs across the State that have been implemented by various units of local government, healthcare systems, community-based organizations, and human services nonprofits. In addition to a need to coordinate these several initiatives, a comprehensive strategy and plan was required to address gaps in opioid-related treatment and prevention services that are noted in the SOR grant application and are identified through the State Overdose Action Plan, and the various needs assessment activities supported by the SOR grants. The need for evaluation for service programs supported by the SOR grant is of critical importance in support of decisions regarding the future design and funding of these services. The SOR grant funds services for persons with opioid and stimulant disorder, including fentanyl, methamphetamine and cocaine, and it is critical that DHS/ DBHR evaluate these new services to determine their importance and usefulness. Given its extensive familiarity with the development of these service programs, and its successful experience in developing strategic programs and plans, AHP is in a unique position to evaluate the SOR grant programs, and to monitor and manage all aspects of the implementation of the State Overdose Action Plan.

Additionally, AHP has been managing meetings of all boards and subcommittees working on overdose prevention in the State including the Council, the IORAB, and the Steering Committee. An award to AHP to continue in this capacity will allow for a seamless transition of these services that would almost certainly not be the case if another vendor assumed responsibility for these services.

5. Has the Agency or University considered alternative supplies or services to satisfy their need? Yes No

5a. If no, why weren't alternatives evaluated?

The federal funder of the SOR grant, SAMHSA, requires that states implement services as quickly as possible following notice of an award, within three months at the latest. Advocates for Human Potential was named in the SOR grant proposal to SAMHSA. We only contract with named providers so that we can quickly implement the contracts. From its experience with SOR and prior grants, DHS/ DBHR knew of AHP's capabilities to successfully provide the needed strategic planning, meeting staff support, process evaluation, and monitoring and report writing services that are critically needed to successfully implement the SOR grant, implement the SOAP, and manage all of the Boards, Councils and groups working on same. DHS/DBHR also knows of AHP's capabilities to implement the State Overdose Action Plan that was managed and written by AHP. This implementation work requires broad knowledge of multiple state agency staff and their initiatives working on the overdose crisis. DHS/DBHR is aware of AHP's national reputation for providing similar professional services to SAMHSA. AHP was named in the proposal to SAMHSA, and this proposed work was approved by SAMHSA. All of these factors supported DHS/DBHR's decision to name AHP as the provider of the strategic planning, process evaluation, meeting coordination, and State Overdose Action Plan implementation services.

6. Are there resellers or distributors?

Yes No N/A

7. What efforts were made to get the best possible price (i.e. did the agency/university negotiate) and how did you determine the price for this purchase is considered fair and reasonable?

The price for the service was determined by funding limitations and the historical cost of the work in prior years. AHP was able to perform the work at the rate of $838,125 during the current contract. This prior price was arrived at based on Federal funding and administrative cost limitations that are no longer required of the State Opioid Response grant. Because of this we were able to include additional work specifications in FY26. Based on previous work from AHP and historical pricing, the additional work was negotiated at $100,000, as a fair and reasonable amount for the additional work. This brings the new contract price to $938,125.

8. Will this purchase obligate the State to this vendor for future purchases such as maintenance, licensing or continuing need?

Yes No

9. What will be the financial or other impact to the State if this sole source is not approved and a competitive bid is required?

DHS/DBHR will not be in compliance with the SOR grant. The SOR funds which total $36,714,994 for each of three years will be in jeopardy, as well as additional funding that might be available from SAMHSA. Additionally, the work of the IORAB, the council and the Opioid Steering Committee is ongoing. Switching providers now would severely impact the State's ability to manage and coordinate the work of the various subcommittees and boards needed to comply with the various federal and state requirements to utilize opioid settlement funds and SOR funds.

10. Is there any additional information you would like to add to justify this sole source?

In 2023 there were 3,502 deaths due to overdose in IL, representing the first decrease since 2018 according to the Department of Public Health. The serious impact of the ongoing overdose crisis affects the residents of the state of Illinois in profound ways. It is incumbent upon us to make the most timely and efficient use of the resources that are available to address this crisis. DHS/DBHR's request for sole source approval to award funding in support of AHP's work assisting DBHR with managing the overarching work of the SOAP, the SOR, the boards and councils, and the opioid settlement funds is critical to enabling us to meet the state's goal of further reducing overdose deaths. This is an ongoing crisis, and AHP has been deeply involved in much of the success we have had in fighting this crisis.

Q2Answer: DHS/SUPR funds programs funded by the Federal Grant to respond to the opioid crisis.

4. Convene and manage the Illinois Opioid Crisis Response Advisory Council (Council).

a. Convene and facilitate quarterly Council meetings.

b. Work with key DHS/SUPR staff to develop agenda.

c. Prepare and distribute Council meeting minutes and other meeting materials.

d. Maintain Council membership and email distribution lists.

Tasks may include:

a. Convening meetings to develop work plans and data collection tools.

b. Working with Chairs and Committee members to develop data collection tools and processes (e.g., focus group and survey protocols); drafting materials and sharing with Chairs and Committee members for review; finalizing data collection tools.

11. Prepare semi-annual reports that document implementation of SOAP recommendations and metrics, Department of Public Health (DPH) overdose data, and new challenges impacting the overdose crisis and SOAP recommendations.

a. Present drafts of SOAP implementation reports to DHS/SUPR key staff for review and approval.

b. As directed by DHS/SUPR, present drafts of SOAP implementation reports to leadership/key staff of State agencies listed in the SOAP DPH, Healthcare and Family Services (HFS), Department of Children and Family Services (DCFS), Illinois Department of Insurance (IDOI), Illinois Criminal Justice Information Authority (ICJIA), Illinois Department of Corrections (IDOC), and Illinois Department of Juvenile Justice (IDJJ) for review and approval.

c. Prepare and disseminate final versions of SOAP implementation reports.

d. As requested by DHS/SUPR, present SOAP implementation results/updates to Council, Committees, State leadership and other groups identified by DHS/SUPR.

Q3Answer: For another consecutive year, the DHS SOR SAMHSA grant application named Advocates for Human Potential (AHP) to provide Advisory Council meeting staffing support, to conduct an evaluation of the multiple programs supported by the SOR grant, and to implement the State Overdose Action Plan for the State.
Q4Answer: The Illinois SOR grant application references the Illinois Statewide Opioid Crisis Response Advisory Council which has been convening since January 2017 to speak to the numerous initiatives and programs across the State that have been implemented by various units of local government, healthcare systems, community-based organizations, and human services nonprofits. The SOR grant funds services for persons with opioid and stimulant disorder, including fentanyl, methamphetamine and cocaine, and it is critical that DHS/DBHR evaluate these new services to determine their importance and usefulness.

Q5aAnswer: The federal funder of the SOR grant, SAMHSA, requires that states implement services as quickly as possible following notice of an award, within three months at the latest. Advocates for Human Potential was named in the SOR grant proposal to SAMHSA. We only contract with named providers so that we can quickly implement the contracts. From its experience with SOR and prior grants, DHS/DBHR knew of AHP's capabilities to successfully provide the needed strategic planning, meeting staff support, process evaluation, and monitoring and report writing services that are critically needed to successfully implement the SOR grant, implement the SOAP, and manage all of the Boards, Councils and groups working on same.

Q7Answer: The price for the service was determined by funding limitations and the historical cost of the work in prior years.

Q9Answer: DHS/DBHR will not be in compliance with the SOR grant.
Q10Answer: In 2023 there were 3,502 deaths due to overdose in IL, representing the first decrease since 2018 according to the Department of Public Health.
