PERFORMANCE WORK STATEMENT
For
ARMY AND AIR FORCE EXCHANGE SERVICE
Annual Safety Advisor (RSPP) and Risk Assessment (DVR) Services
1. SCOPE OF WORK: The Annual Safety Advisor (RSPP) and Risk Assessment (DVR) Services contractor (hereafter referred to as the "Contractor") shall advise, inspect, train, and report to AAFES (Vicenza and Livorno only) regarding all Italian safety requirements/regulations and be appointed by AAFES as Italian safety advisor designated as RSPP, IAW art. 32 D. Lgs. 81/08.
2. LOCATION OF SERVICES: Service shall be performed at the AAFES facilities located at Caserma Ederle, Caserma Del Din, Villaggio and Torri di Quartesolo – Vicenza, Italy and Camp Darby – Pisa, Italy.
In providing a quotation, the contractor shall keep in mind that ninety-five percent of the work effort is in Vicenza.
3. PERIOD OF PERFORMANCE: One base year of twelve (12) months, with two (2) one-year Option Years.
4. HOURS OF OPERATION: Normal office hours at AAFES are 0800 – 1700 hours, Monday through Friday, excluding U.S. Federal Holidays. The contractor shall work no more than 35 hours per week, excluding U.S. Federal Holidays; or any day the AAFES facility is closed in its entirety. The contractor is not authorized overtime under this contract.
5. ABSENCES: If the contractor is unable to perform services, s/he must coordinate the absence with the Contracting Officer’s Representative (COR). The contractor may subcontract out all or part of these services, given that the COR approves the subcontractor in advance, and the contractor has previously trained the subcontractor on all the services provided under this contract.
The subcontractor is required to meet all of the same qualifications as the contractor.
6. QUALIFICATIONS: The contractor must possess:
(a) The contractor shall have the Italian certification delivered by Host Nation (Italy) as RSPP.
(b) The contractor shall have not less than five years of documented experience in working in occupational fields such as industrial hygienist, safety officer/engineer, bioenvironmental engineer, fire prevention engineer, health physicist, or occupational health specialist, with experience in a similar position in a sizable (150-200 employees) organization.
(c) The contractor shall provide documented evidence of previous experience with the Safety Management Systems, e.g.: Occupational Health and Safety (OHS) Assessment Series 18001 (OHSAS 18001).
(d) The contractor shall provide documented evidence of previous experience with safety regulations, fire prevention policies and accident investigations with experience in conducting inspections and performing risk assessments.
(e) The contractor shall provide documented experience in conducting training sessions on OHS.
(f) The contractor shall provide documented experience in interpreting engineering drawings and specifications to identify potential hazardous conditions in proposed construction projects and knowledge of construction standards, practices, building materials, installation of work and equipment hazards.
(g) The contractor shall provide documented experience of working with automated systems, at end-user level, using the following software packages: Microsoft Office Suite, Windows, and AutoCad (Computer Aided Design).
(h) The contractor must be fluent in English (speaking, writing, and reading). Exhibit the ability to communicate in the English language, with reference and/or proof of education.
7. CONFIDENTIALITY: The contractor may encounter Personal Identifying Information (PII).
(a) Proper confidentiality shall be maintained regarding personal information of clients and volunteers, to include social security numbers, telephone numbers, and any other personal information.
(a) Breach of confidentiality shall be grounds for immediate contract termination.
8. PHYSICAL SECURITY:
(a) The contractor shall adhere to established physical security and internal control procedures. Access to office areas shall be monitored and limited to authorized personnel.
(b) The contractor shall secure all files or records before leaving her/his office for a prolonged periods.
(c) The contractor shall be responsible for securing any building or work area of which s/he is the last user of the day. Locking of external doors and windows is necessary when leaving the facility.
(b) The contractor shall be responsible for any keys issued to her/him and shall pay for all costs incurred if lost, such as the replacement of installation locks. All keys issued shall be returned to the COR upon expiration/termination of the contract.
9. SECURITY REQUIREMENTS:
AT Level I Training. All contractor employees, including subcontractor employees, requiring access to Army installations, facilities, and controlled-access areas will complete AT Level I awareness training within 30 calendar days after the contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor will submit certificates of completion for each affected contractor employee and subcontractor employee to the COR prior to issuance of Installation Access Passes.
AT Level I Awareness Training is available online at http://jko.jten.mil/. New employees must complete the training within 30 calendar days of their reporting for duty and submit certificates to the COR within 30 days after completion of the training.
Access and General Protection/Security Policy and Procedures. (This standard-language text is for contractor employees with an area of performance within an Army-controlled installation, facility, or area.)
The contractor and all associated subcontractor employees will comply with applicable installation, facility, and area commander installation/facility access and local security policy and procedures (provided by Government representative). The contractor will also provide all information required for background checks to meet installation-access requirements to be accomplish by the installation provost marshal office, director of emergency services, or security office. The contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA, and local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the force protection condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
All contractor employees with access to a Government information system must be registered in the Army Training Certification Tracking System (ATCTS) at commencement of services, and must successfully complete DOD information assurance awareness training before access to the information system and then annually thereafter.
In accordance with AR 530-1, new contractor employees must complete Level I OPSEC training within 30 calendar days after they report for duty. All contractor employees must complete annual OPSEC awareness training.
All contractor employees and associated subcontractor employees must complete DOD information assurance awareness training before issuance of network access and annually thereafter. All contractor employees working IA/IT functions must comply with DOD and Army training requirements in DODD 8570.01, DOD 8570.01-M, and AR 25-2 within 6 months after being employed.
iWATCH/iSALUTE Training: The contractor and all associated subcontractors will brief all employees on the local iWATCH/iSALUTE program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training will be completed within 30 calendar days after the contract is awarded and within 30 calendar days after new employees commence contract performance, with the results reported to the COR.
Combat Trafficking in Persons: IAW FAR 52.222-50; The United States Government and the United States Department of Defense (DOD) has adopted a zero tolerance policy regarding trafficking in persons.
Contractors, subcontractors and their employees shall not: Engage in severe forms of trafficking in persons during the period of performance of the contract, procure commercial sex acts during the period of performance of the contract, or use forced labor in the performance of the contract.
10. GENERAL CONTRACT SERVICES: The contractor shall accomplish the following in conjunction with the specific contract services detailed herein:
(a) The contractor shall maintain an organized and clean working area.
(b) The contractor is required to keep abreast of the USAG Italy and the Exchange mission, polices and resources. As required, AAFES shall provide the contractor with the schedules for shift work employees, to coordinate morning and/or afternoon classes.
11. SPECIFIC TASKS:
(a) BASIC SERVICES. The AAFES appointed RSPP shall annually inspect all AAFES USAG Italy facilities, develop and maintain the risk assessment documents (DVR), advise and train AAFES personnel regarding mandatory Italian safety regulations/best practices, and maintain AAFES personnel training records. The RSPP will be responsible for a total of no more than 200 people in all installations (Vicenza and Livorno) and will serve AAFES as the Italian Occupational Health and Safety Specialist. In this capacity, the contractor shall function as the technical consultant and coordinator on all safety and occupational health issues.
Contract performance shall be in accordance with (IAW) the following: Article 32 of Italian law decree 81/08), to include monthly site visits (Ederle, Del Din, Villaggio, Torri di Q.lo), quarterly site visits (Camp Darby) and the Safety and Occupational Health Advisory Council meeting in IAW Art 35 of Italian law decree 81/08, “Riunione Periodica.
(b) GENERAL RISK ASSESSMENT OR Documento Valutazione Rischi (DVR): No later than six (6) months after contract award, the contractor shall update the current DVR, in Italian and English, in accordance with CDRL A0001, A1001 and A2001. The DVR is a “living document”; the contractor shall continue to maintain and update the DVR during the contract period of performance, at no additional cost to the Government, in accordance with art 17.1 and 28 of 81/08. The DVR shall include the following assessment: a) work related stress in accordance with art 17.1.II of 81/08; b) work place environmental standards in accordance with Annex V of 81/08; c) equipment in accordance with art 71 of 81/08; d) Personal Protective Equipment (PPE) in accordance with art 77 of 81/08; and e) electrical safety in accordance with art 80 of 81/08 f) pregnant employees in accordance with D.Lgs. 151/01. The assessments criteria must be identified as required by the US ARMY risk assessment code (RAC) IAW DODI 6055.01.
The general assessment must be performed at the level of subtasks of every shop.
(c) ERGONOMIC RISK ASSESSMENT: The contractor shall produce and maintain the ergonomic risk assessment document (DVR) in accordance with art 168, 169 and 174 of 81/08 and ISO 11228 and in accordance with CDRL B0001, B1001 and B2001. The assessment shall be prepared using NIOSH index, OCRA and others international methodologies. The Ergonomic DVR shall match the activities, phases and criteria of the general DVR items listed in item (b) above.
(d) PHYSICAL AGENTS RISK ASSESSMENT: The contractor shall produce and maintain the physical agents risk assessment document (DVR) in accordance with art 181, 190, 202, 209 and 216 and in accordance with CDRL C0001, C1001 and C2001. The DVR shall assess the indoor air quality, noise, and the whole body and hand-arm vibrations transmitted, electromagnetic fields and optical radiations. The Physical Agents DVR shall match the activities, phases and criteria of the general DVR items listed in item
(b) above. The DVR shall have attached the graphs/data of noise/vibration survey or a copy of database used.
(e) CHEMICALS RISK ASSESSMENT: The contractor shall produce and maintain the chemical risk assessment document (DVR) in accordance with art 223, 236 and 249 of 81/08 and in accordance with CDRL D0001, D1001 and D2001. The task requires to collect and to order all MSDS. The Chemical DVR shall match the activities, phases and criteria of the general DVR items listed in item (b) above. The DVR shall have attached all the SDS in Italian and if available in English, no older than 5 years.
(f) BIOLOGICAL RISK ASSESSMENT: The contractor shall produce and maintain the biological risk assessment document (DVR) in accordance with art 271 of 81/08 and in accordance with CDRL E0001, E1001 and E2001. The Biological DVR shall match the activities, phases and criteria of the general DVR items listed in item (b) above. The DVR shall contain the list of Biological agents and the related Standard Operational Procedure (SOP) if required.
(g) ATEX RISK ASSESSMENT: The contractor shall produce and maintain the ATEX (explosive atmospheres) risk assessment document (DVR) in accordance with art 290 of 81/08 and in accordance with CDRL F0001, F1001 and F2001. The ATEX DVR shall match the activities, phases and criteria of the general DVR items listed in item (b) above. The DVR shall have attached the sketches of explosive areas.
(h) FIRE RISK ASSESSMENT: The contractor shall produce and maintain the fire risk assessment document (DVR) and the evacuation plan in accordance with DM 10 Marzo 1998 and or DPR 151/11 and 81/08 and in accordance with CDRL G0001, G1001 and G2001. The Fire DVR shall match the activities, phases and criteria of the general DVR items listed in item (b) above. The DVR shall have attached all the sketches regarding evacuation and the compartments.
(i) DOCUMENTO UNICO VALUTAZIONE RISCHI INTERFERENTI (DUVRI): The contractor shall produce and maintain a model of DUVRI Consolidated risk assessment document in case of services contract in accordance with art 26 of 81/08 and in accordance with CDRL H0001, H1001 and H2001. The model shall consider the services contractors, vendors, and the facilities maintenance agreement with USAG-Italy.
(j) DARBY RISK ASSESSMENT: No later than nine (9) months after contract award, the contractor shall update the current DVR, in Italian and English, in accordance with CDRL I0001, I1001 and I2001.
The DVR is a “living document”; the contractor shall continue to maintain and update the DVR during the contract period of performance, at no additional cost to the Government, in accordance with art 17.1 and 28 of 81/08. The DVR shall include the following assessment: a) work related stress in accordance with art 17.1.II of 81/08; b) work place environmental standards in accordance with Annex V of 81/08; c) equipment in accordance with art 71 of 81/08; d) Personal Protective Equipment (PPE) in accordance with art 77 of 81/08; and e) electrical safety in accordance with art 80 of 81/08 f) pregnant employees in accordance with D.Lgs. 151/01 g) ergonomic in accordance with art 168-169 of 81/08 and h) fire in accordance with DM 10 Marzo 1998. The assessments criteria must be identified as required by the US ARMY risk assessment code (RAC) IAW DODI 6055.01. The general assessment must be performed at the level of subtasks of every shop.
(k) SAFETY TRAINING: The contractor shall conduct training classes (Para. 2 above), and all required teaching materials, for a maximum of 35 students per class, in accordance with articles 36 and 37 of 81/08 and Accordo Stato Regioni 21 Dic 2011 about “Basic Safety”, “Specific Safety Low Risk”, “Specific Safety Medium Risk”, “Safety for Supervisors (Preposti)” in accordance with CDRL A0002, A1002 and A2002. The contractor shall provide a class syllabus for approval by the COR within 30 days of contract award. After acceptance of the syllabus, the contractor shall receive the COR’s acceptance, in writing, of any proposed change to the syllabus. AAFES shall schedule classes 30 days in advance. Once scheduled, the contractor shall provide compelling rationale for not being able to conduct the classes on the scheduled days. Classes may be cancelled by the COR within five (5) working days of scheduled class date with no additional cost to the Government. The contractor shall be responsible for maintaining attendance and training records of all class participants to ensure compliance with all applicable safety regulations. Safety training classes are normally 4-8 hours in duration, depending on the subject matter. The contractor shall provide each class participant that successfully completes the training, a training certificate for their records.
(l) FORKLIFT TRAINING: The contractor shall conduct training classes (Para. 2 above), and all required teaching materials, for a maximum of 35 students per class, in accordance with Accordo Stato Regioni Feb 2012 about forklift operations in accordance with CDRL B0002, B1002 and B2002 The contractor shall provide a class syllabus for approval by the COR within 30 days of contract award. After acceptance of the syllabus, the contractor shall receive the COR’s acceptance, in writing, of any proposed change to the syllabus. AAFES shall schedule classes 30 days in advance. Once scheduled, the contractor shall provide compelling rationale for not being able to conduct the classes on the scheduled days. Classes may be cancelled by the COR within five (5) working days of scheduled class date with no additional cost to the Government. The contractor shall be responsible for maintaining attendance and training records of all class participants to ensure compliance with all applicable safety regulations. Forklift training classes are normally 4-8 hours in duration, depending on the subject matter. The contractor shall provide each class participant that successfully completes the training, a training certificate for their records.
(m) EMERGENCY TRAINING: The contractor shall conduct training classes (Para. 2 above), and all required teaching materials, for a maximum of 35 students per class, in accordance with DM 10 Marzo 1998 and DM 388/2003 about fire prevention and first aid in accordance with CDRL C0002, C1002 and C2002. The contractor shall provide a class syllabus for approval by the COR within 30 days of contract award. After acceptance of the syllabus, the contractor shall receive the COR’s acceptance, in writing, of any proposed change to the syllabus. AAFES shall schedule classes 30 days in advance. Once scheduled, the contractor shall provide compelling rationale for not being able to conduct the classes on the scheduled days. Classes may be cancelled by the COR within five (5) working days of scheduled class date with no additional cost to the Government. The contractor shall be responsible for maintaining attendance and training records of all class participants to ensure compliance with all applicable safety regulations.
Emergency training classes are normally 4-12 hours in duration, depending on the subject matter. The contractor shall provide each class participant that successfully completes the training a training certificate for their records.
12. GOVERNMENT FURNISHED PROPERTY (GFP)/SERVICES: The Government may provide to the contractor for use in connection with this contract the following:
(a) Building – sufficient workspace for one contractor, plus additional space as needed and as facilities allow.
(b) Access to a Class A telephone.
(c) Heat, light, and other utilities.
(d) AAFES will provide printer and copy machine access.
(e) Standard U.S. Army and Government forms and regulations as required.
(f) Office furniture, to include desk, chair, and filing cabinet.
(g) Printing of special forms as needed and approved for use by the Printing and Publications Office.
(h) The Government property made available under this contract shall be for use only in the performance of the contract.
(i) The Government will not be responsible in any way for damage to the contractor’s supplies, materials, equipment, or personal belongings brought into the building, workplace, or on to the grounds due to fire, theft, accident, or other disaster.
(j) Inventory of property will be prescribed by relevant regulation. A complete inventory of all property furnished or purchased by the Government with Government funds will be taken by contractor, witnessed by COR or his/her representative, and reconciled with the community property books. The contractor will be liable for all shortages resulting from contractor negligence.
13. CONTRACTOR FURNISHED PROPERTY: The contractor shall provide her/his own transportation and all necessary equipment to fulfill this contract if not provided as GFP (para 12 above.)
Supplies not available through Government channels shall be purchased at the contractor’s expense. The Government will not be responsible in any way for damages to the contractor’s supplies, materials, equipment, or to personal property because of fire, theft, accident, natural disaster, or other events.
14. CONDUCT: The contractor shall:
(a) Not, through her/his conduct or behavior, engage in activities, which negatively reflect on the office for which the contractor will perform services for the community.
(b) Comply with the Organizational dress code.
(c) Conduct all business and discussion in a professional manner; maintain decorum and language conducive to the conduction of business in a Government setting.
(d) Wear a nametag identifying her/himself as a contractor, and if allowed access to a Government computer must ensure that in all correspondence the contractor ensures that she/he identifies her/himself as a contractor.
15. QUALITY CONTROL: The contractor shall develop and maintain an effective Quality Control Plan (QCP) to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s QCP is the means by which he assures himself that his work complies with the requirement of the contract. The contractor shall submit the QCP to the COR for approval within 7 (seven) calendar days after contract award. After acceptance of the QCP, the contractor shall receive the Contracting Officer’s (KO) acceptance, in writing, of any proposed change to the QCP. This is a CDRL!!!
16. DEFINATIONS AND ACRONYMS:
(a) DEFINITIONS:
1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
11. RSPP. Person in possession of the capacity and professional requisites designated by employer, to whom s/he refers, for the coordination of the risk protection and prevention as per art. 2 para f of law decree 81/2008.
12. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
13. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.
14. WORK WEEK. Monday through Friday, unless specified otherwise.

18. SAFETY: The contractor shall be aware of local safety requirements and ensure that all reasonable efforts are made to protect all persons from harm and U.S. Government property from damage.
19. CONTRACTOR MANPOWER REPORTING (CMR) (CLIN 7500):
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the "Annual Safety Advisor(RSPP) and Risk Assessment (DVR) Services” via a secure data collection site.
The contractor is required to completely fill in all required data fields using the following web address:
http://www.ecmra.mil/, and then click on “Department of the Army CMRA” or the icon of the DoD organization that is receiving or benefitting from the contracted services. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 and at the end of the period of performance for each calendar year, beginning with 2017. Contractors may direct questions to the help desk by clicking on “Send an email” which is located under the Help Resources ribbon on the right side of the login page of the applicable Service/Component’s CMR website. For Contractor Manpower Reporting CLIN (CLIN 7500) the offeror shall propose a price for each CLIN to cover all reporting costs. If the offeror proposes to provide this report at no additional cost to the Government, it should indicate $0.00 or, “No Charge” or rather than not addressing the line item.
