CLAUSES INCORPORATED BY FULL TEXT

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

Factor 1- Technical

Quotes will be evaluated on whether the proposed items meet the salient characteristics outlined in the solicitation, and whether the proposed products are Trade Agreement Act (TAA) compliant as demonstrated by the offerors certification listed in 52.212-1. Quotes which fail to meet the salient characteristics or are not TAA compliant will be determined "unacceptable" and will not be considered for award.

Factor 2 – Price

a. The Government will calculate the Total Evaluated Price offered for award purposes by adding the sum of the total price for all priced CLINs. The offeror’s price will be calculated by adding the total of all CLIN/SLIN/ELIN extended prices.

b. In the event there is a difference between a unit price and the extended total amount, the unit price will be held to the intended quote and the total recomputed accordingly. If the quote provides a total amount for a contract item but fails to enter the unit price, the amount divided by the specified quantity will be held to be the intended unit price.

(End of provision)

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018)
