About this file

The document is an Invitation for Bid (IFB) P2025202 issued by the California Department of Fish and Wildlife (CDFW) for the Spenceville Wildlife Area (SWA) in Nevada and Yuba counties. The IFB seeks a permit for excess vegetation disposal through grazing on approximately 1,380 acres of Parcel 1 within the wildlife area. The grazing period will be four months annually from January 1 to April 30, with a total permit term of four years and five months, commencing December 1, 2025. A mandatory site inspection is scheduled for April 30, 2025, at 9:00 a.m., and bids must be received by May 8, 2025, at 1:00 p.m., with a proposed award date of May 16, 2025.

The permit allows for approximately 172 Animal Unit Months (AUMs) monthly, not to exceed 688 AUMs annually, with bidders required to demonstrate livestock health and capability. The grazing is intended to manage vegetation, reduce fire risk, and promote wildlife habitat diversity by controlling non-native grasses. Bidders must submit a comprehensive bid package including attachments such as a Statement of Qualifications, References, and Site Inspection Certification. The bid will be awarded to the responsive, responsible bidder offering the highest price per AUM per month, with the CDFW reserving the right to reject any or all bids and modify the IFB as needed.

1. Did the firm/individual satisfactorily complete the obligations within the terms of the agreement? (Yes or No)

2. What was the firm’s/individual’s ability to respond if called upon for an emergency?

If any reference provided by the bidder answers “No” to any of the question(s), the bid will be disqualified on the grounds that the bidder did not meet the minimum qualifications, and the bid is therefore non-responsive.

d. CDFW will evaluate each bid to determine its responsiveness to the published requirements.

e. Bids that contain false or misleading statements, or which provide references that do not support an attribute or condition claimed by the bidder, may be rejected.

f. The CDFW reserves the right, at its sole discretion, to request clarifications of bids or to conduct discussions for the purpose of clarification with any or all bidders. The purpose of any such discussions shall be to ensure full understanding of the bid. If clarifications are made as a result of such discussion, the bidder shall put such clarifications in writing. The Permit award, if made, will be to the responsive, responsible bidder offering the highest price per Animal Unit Month (AUM) per month as completed on the Bid Form (Attachment 4).

Bid responses must comply with all IFB requirements. Failure to do so will disqualify the bid. If it is determined not to be in the best interest of the STATE, CDFW reserves the right not to award a Permit in response to this IFB.

In the event of a tie for the responsive/responsible highest bid, the names of the tied bidders will be placed in a container suitable for a blind drawing. The bidder whose name is drawn first will become the proposed awardee. The remaining bidder names will be noted in the order they are drawn for use in offering the award, should the proposed awardee be disqualified or resigned prior to execution of the Permit.

7. Disposition of Bid

a. Upon opening, all documents submitted in response to this IFB will become the property of the STATE.

b. Upon the completion of the bid opening and any relevant submission verifications, indicated by a notice of intent to award the Permit, the bids and associated materials shall be open for review by the public to the extent allowed by the California Public Records Act (Government Code sections 6250-6270 and 6275-6276.48). Insurance documents must be provided on or before the requested date.

STATE execution of the Permit is contingent upon the verification of the insurance by the Department of General Services – Office of Risk and Insurance Management. (The awardee should provide the Sample Permit and the Land Use Agreements: Guide to Insurance Documentation Requirements to their insurance broker when requesting the coverage and required documents.)

b. The proposed awardee will be required to provide a completed Payee

Data Record form (STD 204) with the documents described above.

c. Time is of the essence for the commencement of this Permit. CDFW reserves the right to rescind the award if any requested documentation is not provided by the awardee on or before the requested due date. The awardee is solely responsible for ensuring timely responses by any individual or firm they choose to create and provide the requested documents.

d. CDFW reserves the right to offer the award to the next responsive, highest bidder or to issue a new IFB if the award is rescinded.

e. Upon receipt, the awardee will sign the provided originals (either two or three original sets, based on the agreement’s dollar value) of the Permit for Excess Vegetation Disposal and return all signed originals within ten business days after receiving receipt from CDFW.

f. The Permittee is not authorized to commence activities (including any pre-season preparation work) prior to receiving a fully signed and executed Permit and remitting payment of the first Permit fee installment as described in the Permit.

9. Protest

a. In Accordance with Public Contract Code Section 10345, if any bidder, prior to the award of an agreement, files a written protest with the Department of General Services (DGS) – Office of Legal Services and CDFW on the grounds that the (protesting) bidder is the lowest responsive responsible bidder, the agreement will not be awarded until either the protest has been withdrawn or the DGS has decided the matter. The protest must be sent to:

Following the award of the Permit the CDFW will prepare a Permit for Excess Vegetation Disposal including exhibits for execution. By submitting a bid, the successful bid agrees to sign and return DFW 587 within ten business days of receipt.

11. Generative Artificial Intelligence (GenAI) Requirements

The State of California seeks to realize the potential benefits of GenAI, through the development and deployment of GenAI tools, while balancing the risks of these new technologies.

Bidder / Offeror must notify the State in writing if it: (1) intends to provide GenAI as a deliverable to the State; or (2), intends to utilize GenAI, including GenAI from third parties, to complete all or a portion of any deliverable that materially impacts: (i) functionality of a State system, (ii) risk to the State, or

(iii) Contract performance. For avoidance of doubt, the term “materially impacts” shall have the meaning set forth in State Administrative Manual (SAM) § 4986.2 Definitions for GenAI.

Failure to report GenAI to the State may result in disqualification. The State reserves the right to seek any and all relief to which it may be entitled to as a result of such non-disclosure.

Upon notification by a Bidder / Offeror of GenAI as required, the State reserves the right to incorporate GenAI Special Provisions into the final contract or reject bids/offers that present an unacceptable level of risk to the State.

14. Exhibit B: Site Operation Plan

Spenceville Wildlife Area – Parcel 1

The Spenceville Wildlife Area (SWA), located in Nevada and Yuba counties of northern California, consists of 11,942 acres of woodland habitats characteristic of the Sierra Foothills. The management of the SWA was transferred from the General Service Administration (GSA) to the Wildlife Conservation Board in 1962 to protect, enhance and restore Valley Foothill Riparian Forest, stream habitats, Fresh Emergent Wetlands; in addition to providing hunting, fishing and other compatible activities for the public. The lands found within the SWA boundaries have historically been grazed by cattle and the California Department of Fish and Wildlife (CDFW) has had the property managed with cattle leases since 1963.

Grazing Objectives: Removal of excess vegetation is needed to provide fire control and help reduce invasive species on Parcel 1, referred to as the Premises, approximately 1,380 acres within the SWA. Grazing will reduce dense annual grass ground cover, providing suitable wildlife feeding areas and promote the growth of desirable plant species. Livestock grazing occurs in grassland and vernal pool areas and is used as a management tool to promote diversity of species, while providing the added benefit of reducing the risk of catastrophic wildfires with the reduction of non-native grasses.

Seasonal grazing permitted during the winter and early spring months will allow the CDFW to meet these goals.

Approximately 172 Animal Unit Months (AUMs) monthly, not to exceed 688 AUMs annually, will be allowed to graze the Premises. An AUM is one cow-calf or one bull for one month. Cattle may be moved into the Premises January 1 each year of the Permit term and will be removed by April 30 each year during the Permit term.

The Permittee shall immediately notify the CDFW in writing of brands which identify their cattle and the numbers of cattle bearing each brand which they place upon or remove from the Premises. Such a notice will be made at least two weeks in advance of any such move. The CDFW may have a representative present to inspect and determine the numbers of such cattle.

The Permittee agrees and understands that the Premises was formerly used by the Department of the Army as a firing range and was contaminated by introduction of unexploded and dangerous shells or other forms of ammunition, either upon or below the surface thereof, and the Department of the Army is unable to certify that the Premises has been completely cleared and decontaminated and is unable to state whether or not the same is safe for use. The Permittee herein covenants and agrees for itself, successors and assigns, to assume all risk and liability for all personal injuries and property v damages arising out of maintenance, use and occupation of the Premises by the Permittee; and further covenants and agrees to indemnify and save harmless the State of California, its officers, agents and employees against any and all liability, claims, causes of action or suits due to, arising out of, or resulting from occupation, or presence of the Permittee or its agents, servants, or employees.

It is agreed and understood that title to the Premises is vested in the State of California by virtue of quitclaim deed dated December 17, 1962, from the Department of the Army, and use of the Premises by the Permittee is subject to all applicable terms and conditions, therefore. It is agreed by the Permittee that in the event title to the Premises reverts to the Department of the Army, this permit agreement shall immediately terminate, and that the consideration paid by the Permittee to the CDFW in lawful money of the United States shall be prorated to the date of such termination.

The Premises will be monitored by the CDFW to ensure objectives are met.

The wildlife’s response to these areas may also be monitored if time and personnel are available.

Topography: The Premises consists of open grassland, rolling blue oak woodlands, and steep terrain with rocky out cropping.

Soil: Soils on the Premises are mapped primarily as Auburn-Rock outcrop complex, Auburn Loam, and Argonaut-Auburn complex, as reported in the United States Department of Agriculture (USDA) Web Soil Survey (WSS).

The WSS reports show these soils have a Medium Soil Compatibility Risk rating. This rating indicates that the potential for compaction is significant, and that the growth rate for seedlings may be reduced following compaction.

Stocking rates and grazing seasons should be adjusted to minimize compaction risks. The WSS reports much of the Premises is mapped at a moderate to severe Erosion Hazard. A moderate rating indicates that some erosion is likely, and a severe rating indicates that significant erosion is expected on disturbed soils. With these ratings, stocking rates and grazing seasons should be adjusted to ensure soils aren’t exposed by overgrazing.

Wildlife: The habitat supports several game species, including Black Tailed deer, wild turkeys, California quail, western blue birds, acorn woodpeckers, and rattle snakes are all common on the Premises. Black rail (threatened) is also known to be present on the Premises. Since the Premises is managed to support wildlife, conflict with predators is possible and must be considered a business risk.

Habitats/Vegetation: Habitats on the Premises are primarily foothill pine/blue-oak savannah, with an understory of annual grasses. Seasonal streams and permanent ponds are located throughout the Premises.

vi

Fencing/Corrals: Wildlife friendly fencing is on the Premises. Old corrals are on the Premises; the Permittee may bring on extra panels for loading purposes. Fencing condition and quality will be accepted “AS-IS” and will be maintained at the sole cost of the Permittee.

Water: Water access on the Premises is through streams and ponds. The Permittee understands and agrees that the CDFW does not guarantee the availability of water, or the quantity of any water that may be available on the Premises. The Permittee will be responsible for bringing water into troughs, or the infrastructure will be placed in coordination with the CDFW Site Manager.

Current Management: Livestock grazing occurs in grassland and vernal pool areas and is used as a management tool to promote species diversity, while providing the added benefit of reducing the risk of catastrophic wildfires with the reduction of non-native grasses.

Public Use: The Premises is open for public use year-round; hiking, horseback riding, wildlife viewing, and is open to hunting September 1 through January 31, and during the spring turkey season. The Permittee must allow these activities to commence and is expected to be courteous to members of the public.

Incompatible Activities: No special right to access the Premises for the purposes of hunting, fishing, camping, or any other purpose other than as specified in the Permit is granted nor implied.

The Permittee may not take (as defined in FGC 86) wildlife (including rodent and predator control) unless prior written authorization is obtained from the

CDFW.

The Permittee may not grant special access to the Premises to any person not associated with the implementation or the management of vegetation control activities under the Permit.

Grazing Prescription: Approximately 172 AUMs monthly, not to exceed 602 AUMs annually, will be allowed to graze the Premises. Cattle may be moved into the Premises January 1 each year of the Permit Term and removed by April 30 each year of the Permit Term. The suggested AUM is cow-calf pair = 1 AUM, dry cow = 1 AUM, mature bull = 1.35 AUM and yearling cow = 0.6 AUM. The target Residual Dry Matter (RDM) of 1,000 lbs./acre will be measured annually.

Cattle Health: The Permittee will be required to demonstrate livestock is healthy prior to being introduced to the Premises, and ensure they remain healthy while on the Premises. The Permittee will be required to remove any sick cattle from the Premises for prompt veterinary care.

vii

CDFW Monitoring: The CDFW’s personnel or their agents may be on the Premises during the annual grazing season to construct exclusionary fencing, remove invasive species, reduce fuel loads, and restore riparian areas. The Permittee will be notified prior to the construction of any exclusionary fencing.
