Site Remedial Action at Valley Forge National Historical Park, Upper Merion Township, Montgomery County, PA. VAFO Remediation
Subject: Questions and Answers for Solicitation P16PS00823, Amendment 2
Q&As for Amendment 1
1. Question: Does the Combined Synopsis/Solicitation under solicitation number P16PS00832 contain requirements similar to a current contract? If possible, please provide the current contract number. Or, is this a new requirement for the government?
Answer: This is a new requirement.
2. Question: The Pre-Solicitation Notice stated this was an 8(a) set-aside. Is it still an 8(a) set-aside?
Answer: This solicitation is a competitive 8(a) set aside.
Q&As for Amendment 2
3. Question: Does all bonding have to be acquired at the beginning of the project, or can the project be bonded in phases?
Answer: All performance and payment bonding for the entire project must be in place within 14 days after contract award.
4. Question: Does the offeror have to have a bonafide office in the geographic region of the project?
Questions and Answers – Solicitation Amendment 2
Answer: The offeror is not required to have an office in the geographic region. However, it is required that a project trailer be kept on site and the offeror must be capable of effectively managing and completing the project.
5. Question: Why does the offeror need to submit ten similar projects in the recent past?
Answer: The experience form incorrectly requests a “minimum” of ten projects, the text should have indicated a “maximum” of ten projects. There is not a specific number of projects the offeror needs to include on the experience form.
6. Question: Will the offeror be required to do verification sampling?
Answer: No, the offeror will not be required to do verification sampling.
7. Question: Did the National Park Service apply for the 404 permit?
Answer: No, this remedial action is being completed under CERCLA (Comprehensive Environmental Response, Compensation, and Liability Act of 1980). CERCLA specifically excludes remedial actions undergoing any permitting/approval processes. Although no permits are required for any action completed under CERCLA, the project must meet the substantive requirements of any permit that may be required. The federal, state and/or local requirements to be addressed during the remediation (identified as Applicable or Relevant and Appropriate Requirements [ARARs]), including Section 404 of the Clean Water Act have been identified and are listed in the Supplemental Remedial Design Report, Volume 1, Table 11-1.
All activities conducted during this remedial action must be completed in accordance with the Supplemental Remedial Design Report to ensure compliance with all identified ARARs.
8. Question: Due to the extensive requirements of this project, will the offerors be able to conduct additional site visits / site surveys?
Answer: Offerors may set up an additional park visit. To schedule an additional visit, contact Donna Davies at donna_davies@nps.gov and copy Nicole Jensen at Nicole_jensen@nps.gov . Any questions arising during additional site visit(s) must be formally submitted to the contracting office in writing; Personnel escorting contractors on any additional site visit(s) will not answer questions.
9. Question: In the Former Keene Plant, does the vegetation need to be grubbed and removed off site?
Answer: Areas that are covered only in grassy vegetation shall be mowed flat to a height of approximately 2” prior to warning layer placement and covering with clean fill. Areas covered in shrubby bushes or trees must be cleared and removed off site. Trees are to be cut flush with the surface of the ground and the tree stumps below ground remain in place.
10. Question: In the areas to be filled rather than excavated is the fill to be placed at a thickness of 2 feet up to the design boundary and sloped from there or sloped up to the design boundary?
Answer: As discussed in the Supplemental Remedial Design Report, Volume 1, Section 4.0, in areas where no soil will be excavated, 2 vertical feet of clean fill will be placed over the mailto:donna_davies@nps.gov mailto:Nicole_jensen@nps.gov warning layer to cover the design dimensions (as shown in Volume 3 of the Supplemental Remedial Design Report). Fill will be placed along the outside edges of the remediation design area to achieve a 5-foot horizontal to 1-foot vertical grade until intersecting with the existing ground surface.
11. Question: Does the contractor need to remove the deer fencing?
Answer: See Supplemental Remedial Design, Volume 1, Section 4.0, 3rd paragraph.
12. Question: Will there be weather delays or will work need to be completed during inclement weather?
Answer: As stated in Supplemental Remedial Design Report, Volume 4, Section 02221 Contaminated Soil Excavation and Handling, Part F. Work Restrictions: No excavation or loading will be conducted when raining.
The 350 day Period of Performance accounts for a number of reasonably anticipated weather delays. If the contractor feels that inclement weather has unusually delayed the project, they can request that the contract be modified to extend the Period of Performance.
1. In order for the Contracting Officer to award a time extension, the following conditions must be satisfied:
a. The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the contractor. A Time Impact (TIA) Analysis will be required to substantiate the request for additional time due to weather.
2. The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The contractor’s progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.
3. Upon acknowledgement of the Notice to Proceed (NTP) and continuing throughout the contract, the contractor will record on the daily Contractor Quality Control report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the contractor’s scheduled work day.
13. Question: Is the Aqua PA tie-in near County Line Road still available?
Answer: Aqua PA has removed this water supply line tie-in. There are no other tie-in locations available to the contractor. NPS will not be providing any water for this contract. The contractor is responsible for supplying all water required for the project.
14. Question: What additional OSHA requirements are relevant for this project?
Answer: The contractor will determine which OSHA requirements are applicable in their Health & Safety Plan.
15. Question: Is the County Line Road Permit closure still valid?
Answer: The National Park Service will continue to renew the permit issued by Pennsylvania Department of Transportation (PennDOT) to close County Line Road. The contractor will be required to provide a “Trained Flagger” in accordance with PennDOT publication 408 when any trucks enter or exit County Line Road onto Route 23.
16. Question: Will the full data for sampling be provided to offerors?
Answer: The analytical results discussed in the Supplemental Remedial Design Report, Volume 1, Section 4.0 and provided in Tables 4-1 through 4-36 summarize all analytical data required to respond to this solicitation; therefore, NPS will not be providing any additional data.
17. Question: Will TCLP sampling from the previous project be provided to offerors?
Answer: No; For purposes of developing their price proposals, offerors may assume that the waste categorization sampling completed by the awardee will determine that the soil to be excavated and disposed offsite will not meet the criteria to be categorized as a hazardous waste under the Resources Conservation and Recovery Act (RCRA). If the waste categorization analysis conducted by the awardee indicates soil located in excavation areas is categorized as hazardous the Government will consider this as a “differing site condition” and it will be addressed accordingly.
The determination, if the materials to be excavated and disposed of off-site, to be hazardous or non-hazardous in accordance with RCRA does not impact the handling, transportation and disposal of soils located in areas that have been determined to contain asbestos at concentrations exceeding 1% (FKP-F/G/J, FKP-A, and HIB-C3). All materials located within these areas must be transported and disposed of in accordance with all applicable federal and state regulations (see Supplemental Remedial Design Report, Volume 1, Section 8 and Volume 4, Section 02223).
18. Question: Can unlicensed trucks be used on County Line Road?
Answer: Unlicensed trucks may be used on County Line Road because it is currently closed to vehicular traffic, under an existing PennDOT / NPS permit (See answer to Question 15), but may not travel on Route 23 or any other non-closed public road or road located with the park boundaries.
19. Question: Do large trees need to be removed?
Answer: Any trees located within the remediation design footprint must be removed, hauled, and properly disposed of offsite.
20. Question: What is the weight limit on County Line Road?
Answer: There is no weight limit on County Line Road.
21. Question: Is the area where WCRS located a drainage creek?
Answer: The area known as WCRS is not a perennial stream.
22. Question: What if the offeror determines a different quantity from the quantities provided in the Supplemental Remedial Design Report?
Answer: Offerors should prepare their price proposals using the quantities listed in the Supplemental Remedial Design Report. If these quantities are determined through documentation to be inaccurate, the Government will address this as a differing site condition and will modify the contract accordingly.
23. Question: Will any material that has been chipped need to be moved offsite?
Answer: Yes, all chipped material must be removed and properly disposed of.
24. Question: Can the chip material be used as temporary roads?
Answer: Yes, but these areas must be restored after use in accordance with the Supplemental Remedial Design Report, Volume 2, Section 4.0.
25. Question: Will asbestos material need to be moved into burrito bags?
Answer: All excavations where asbestos above 1% (FKP-A, FKP-F/G/J, and HIB-C3) has been identified must be handled, transported and properly of disposed in accordance with all applicable federal and state regulations (See Supplemental Remedial Design Report, Volume 4, Section 02223).
26. Question: Do the logs that are already onsite need to be removed?
Answer: The logs that are already onsite do not need to be removed.
27. Question: How will the contractor get to the various work sites?
Answer: Access roads for each remediation area have been included in the design drawings (see Supplemental Remedial Design Report, Volume 3).
28. Question: Do the root systems need to be removed prior to placement of fill in areas that will not be excavated?
Answer: Areas covered only in grass and weeds should be mowed to a height of approximately 2” prior to placement of the warning layer and fill but should not be grubbed (See response to Question #9).
29. Question: Will the offeror be responsible for surveying the maintenance area?
Answer: Yes, the offeror will be responsible for surveying the maintenance area.
30. Question: Are the seven monitoring wells accessible?
Answer: Offerors should base their pricing assuming all seven monitoring wells are easily accessed with off-road equipment. The locations of monitoring wells are provided in the Supplemental Remedial Design Report, Volume 1, Appendix B.
31. Question: Will the offeror be responsible for providing archeological surveying of the maintenance area?
Answer: No, the offeror will not be responsible for any archeological surveying of any remediation areas. NPS is completing all required archeological surveys prior to start of the remediation. See Supplemental Remedial Design, Volume 1, Section 10.
32. Question: How should potential archeological resources be cleared?
Answer: See answer to question 31.
33. Question: Were there any unforeseen circumstances that arose during the previous project?
Answer: To the Government’s knowledge, the Government did not encounter any unforeseen circumstances.
34. Question: Solicitation Section I.18 (page 81) requests a 20% bid guarantee or $1,500,000, whichever is less. Form 1442 indicates a bid bond is not required for the project.
Please clarify which is correct.
Answer: Form 1442 contains an error – this project requires a 20% bid guarantee or $1,500,000, whichever is less.
35. Question: Section L.13.C.2, (pg. 136) requests that Offerors identify the “Health and Safety Manager.” Please clarify whether this key personnel position is the lead individual with overall health & safety responsibility for the Contract or the individual who will be on site on a full-time basis during active field work on the project.
Answer: Section L.13 is a Provision; this question refers to Section L.14.C.2. The Health and Safety Manager key personnel position is the individual with overall health and safety responsibility for Contractor employees and does not need to be present onsite full time. The Contractor employee present during on-site activities is the health and safety officer discussed in the Supplemental Remedial Design Report, Volume 2, Section 2.2. The key personnel position identified in SectionL.14.C.2 as Project Manager is analogous with the Construction Manager discussed in the Supplemental Remedial Design Report, Volume 2, Section 2.2. This individual will be the main point of contact for NPS and will be responsible for coordinating and controlling Contractor submittals, logistics and Site activities and will be responsible for Site workers, equipment and subcontractors. The Site Supervisor position will be present onsite full time and assist the Construction Manager in managing daily Site activities.
36. Question: Section L.13.C.2, (pg. 136) requests information on the Offeror’s annual contracts (both Federal and non-Federal) for the past five years. The solicitation requires substantial information elsewhere sufficient for demonstrating that Offerors as well as subcontractors, and key personnel have the capabilities, experience, and past performance to demonstrate the ability to perform this project. The additional contract detail required by this section of the solicitation is time consuming to put together and will not contribute significantly to evaluating Offeror’s proposals beyond that already being provided elsewhere in the proposal.
Additionally, some of this information is considered confidential by Offerors’ clients. We respectfully request the last paragraph of Section L.13.C.2 be deleted from the solicitation.
Answer: Section L.13 is a Provision; this question appears to refer to Section L.14.C.2.
The Government will change the requirement in Section L.14.C.2. to the past three years, instead of the past five years. Effective as of the issuance of Amendment 2, the last / fifth paragraph of Section L.14.C.2 now states:
“The proposal should also include the prior experience of the Offeror (general contractor), key subcontractors and proposed Key Personnel on similar projects. A listing of the Offeror’s annual contracts (both Federal and non-Federal) for the past three years should be provided.”
37. Question: Sections L.14.C.3 (pg. 136) and Section M.B.5.C (pg.140) for Factor 3, Project Management and Scheduling differ somewhat and it’s not entirely clear what information is required. Please clarify exactly what Offerors are to provide and what criteria proposals will be evaluated against for Factor 3.
Answer: The Offeror should detail the management and scheduling aspect of the project including the planning, coordination, and control over the various tasks to be completed. The Offeror should also discuss the management of subcontractors, deliverable submission and lines of communication within the Offerors’ team and NPS. The Offeror should detail the methodologies, systems, or software that will be employed to assist in effectively managing the project.
38. Question: Attachment 5, Section 3.0, [pg. 4, Performance Work Statement (PWS)] mentions institutional controls and references Volume 1 (Remedial Design, Attachment 1).
Please clarify that institutional controls as defined in Section 9.0 of Volume 1 will be obtained by the National Park Service or others on their behalf, and are not included in the scope of work to be implemented by Offerors on this project.
Answer: The institutional controls the Contractor is responsible for are:
(1) placement of warning layer at base of all excavations or fill areas located in the FKP and WCRS (with the exception of WCRS-G South) areas as discussed in the Supplemental Remedial Design Report, Volume 1, Section 4.0 and shown in the design drawings (Volume 3),
(2) surveying locations of all warning layers placed during the supplemental remediation, and
(3) identifying location and dimensions of the warning layers in the as-built drawings.
39. Question: Attachment 6, Section 01 2700 (Definition of Contract Line Items) – Will progress payments will be allowed for key milestones within individual Contract Line Item Numbers 2 through 6 (e.g., separate progress payments for site preparation, remediation, and restoration for a given Area of Concern), especially given the time required to establish vegetative cover to complete restoration?
Answer: In accordance with Section I.90, Clause 52.232-5, PAYMENTS UNDER FIXED-PRICE CONSTRUCTION CONTRACTS, monthly progress payments will be made.
40. Question: Attachment 13, Past Performance Questionnaire is provided with the solicitation but is not referred to in Section L (Proposal Preparation Instructions). Can Offerors provide CPAR reports and/or other questionnaires previously prepared for other Federal procurements that provide similar information to avoid burdening Federal clients with duplicative information requests?
Answer: It is understood that CPARs will be submitted for most past performance information – Attachment 13 is provided to use if an offeror wishes to provide an assessment other CPARs and other Governmental performance assessments.
41. Question: Work Plans for Previous Remediation at the Site – The previous incumbent contractor, who was present with an 8(a) firm during the pre-bid site visit, has access to work plans from the last phase of site remediation. So all Offerors are operating from the same information base, please provide a copy or electronic access to all work plans prepared during the prior phase of remediation at this site. During the upcoming supplemental remedial action contract, will all work plans for the prior phase of remediation at this site be made available in editable (e.g., Microsoft Word) form for use by the Offeror selected for this contract?
Answer: The Work Plans will be developed by the awardee, specific to this project, after the award of the contract. The Work Plans from the previous contract as mentioned in the question is not applicable to this project as this is a separate project with separate requirements.
NPS expects the Work Plans for VAFO Remediation to follow VAFO Remediation Work Plan requirement in accordance with The Performance Work Statement, Section 5.0 – Project Deliverables. The Work Plans are to be created by the awardee after the award to demonstrate how the awardee will execute the project following the award and it is considered proprietary information as well as mean and methods. Therefore, Work Plans from previous projects will not be shared.
42. Question: Approved Backfill Source(s) – So all Offerors are proposing based on the same information base, please provide the names/locations of previously-approved sources of backfill and topsoil used for VAFO remediation.
Answer: It is up to the offerors to select sources of backfill and topsoil.
43. Question: It’s my understanding that this solicitation is for 5 remaining AOCs of an original 11 identified. There was a contract previously awarded for the 6 currently remediated sites. Can you provide any info as to the contract value, name of contractor awarded that work, copy of the contract, etc.?
Answer: Valley Forge National Historical Park, Hazardous Waste Excavation and Site Restoration, VAFO – 137236, P12PC20530, was awarded to Frontier Services in the amount of $6,298,530.00. NPS reminds offerors that this is a different project with different expectations.
44. Question: Extension Request – Based on the extent of information required by the Solicitation, we respectfully request a 1-week extension of the proposal due date to June 30, 2016.
Answer: An extension is granted. The new proposed due date is July 6, 2016 at 2:00 pm, Mountain Time (4 pm Eastern Time).
